A. 
All canopies shall be constructed of fabric. Supporting frames, arms, brackets and other devices shall be constructed of incombustible and corrosion- and mildew-resistant materials. Canopies shall be of those solid colors, only, from samples located in the Village Hall. All canopies shall only be of such shape, design and/or decoration as shall be approved by the Architectural Review Board.
B. 
The sample colors shall be set by the Board of Trustees by resolution of a majority vote of its members present at a Board meeting.
A. 
Depth of sidewalk. All canopies shall be prohibited, except where the depth of the public sidewalk shall exceed 10 feet from building line to curb in Cedarhurst Station Plaza only.
B. 
Height above sidewalk, canopies. All canopies shall be constructed and erected so that the lowest portion thereof shall be not less than eight feet and the highest portion not more than 10 feet above the level of the sidewalk or public thoroughfare.
C. 
Setback from curbline, canopies. No canopy shall be permitted to extend beyond a point 18 inches inside the curbline.
D. 
Width, canopies. No canopy shall be permitted to exceed eight feet in width.
The framework of all canopies shall be designed by a structural engineer and approved by the Building Official as in compliance with the Building Code of the Village of Cedarhurst. All frames and supports shall be of metal and designated to withstand a wind pressure as set by the Building Department of the Village of Cedarhurst.
No advertising shall be placed on any canopy, except that the name of the owner and the business conducted within the premises may be painted or otherwise permanently placed in a space not exceeding eight inches in height on the front and side portions thereof.
Permits for canopies shall be required as provided in § 86-5 of Article I, Awnings. However, a permit shall not be issued unless the plans for the canopy shall have been submitted to and approved by the Architectural Review Board of the Village of Cedarhurst. Canopies shall be subject to annual inspection, and fees shall be set in accordance with § 86-6 of said Article I.
Insurance shall be required as set forth in § 86-8 of Article I, Awnings.

Any person violating any provision of this article shall be liable to a penalty set in accordance with Chapter 1, Article III, General Penalty.
