The Township of Hatfield and the Township of Montgomery are both serviced
by the Colmar Volunteer Fire Company. In order to promote clarification as
to the workmen's compensation insurance benefits between the two municipalities,
the parties have authorized the following agreement:
A. This article shall act as an agreement between the parties
when it has been effectively passed by all parties through the proper legislative
methods.
B. This agreement shall only apply for the assignment of
fire company personnel for the purposes of workmen's compensation insurance
as required by state law and shall not in any way direct or be controlling
on the Colmar Volunteer Fire Company, a nonprofit corporation, as to the disbursal
of personnel for legitimate fire company purposes.
C. The Fire Chief of the Colmar Volunteer Fire Company shall
assign for the purposes of this agreement personnel under his command to the
substation in Hatfield Township or the substation in Montgomery Township.
The list attached as Exhibit A shall be the fire company members assigned for workmen's
compensation insurance to cover the Hatfield station. The said list is made
a part of this article and shall be updated as members of the fire company
are either dropped from the rolls or added to the rolls.
D. The list known as Exhibit B, which shall become a part of this article, shall be the Colmar
Fire Chief's assignment of certain members to the substation located
in Montgomery Township. The said list is made part of this article and shall
be updated as members of the fire company are either dropped from the rolls
or added to the rolls.
E. The lists known as Exhibits A and B, as supplemented,
shall be provided on a regular basis to be maintained in the Township offices
of Hatfield Township and Montgomery Township with a totally revised listing
to be provided quarterly to each municipality.
Hatfield Township and Montgomery Township shall agree to file workmen's
compensation claims with their respective workmen's compensation insurance
carriers for injured Colmar Volunteer Fire Company personnel assigned to substations
located within their respective municipalities in accordance with the exhibits
attached hereto.
This cooperative agreement shall, after approval by the governing bodies
of all participating municipalities, be in full force and effect and binding
on such participating communities and not before. This agreement cannot be
voided without six months' notice, the said notice to be delivered by certified
mail to the respective municipalities.

The Board of Commissioners shall annually certify to the Auditor General
of the commonwealth the name(s) of the active associations and the percentage
of service they contribute to the protection of the Township. Such certification
shall be on forms prescribed by the Auditor General.
There is annually appropriated from the Township Treasury all such sums
of money that may hereafter be paid into the Township Treasury by the Treasurer
of the State of Pennsylvania on account of taxes paid on premiums of foreign
fire insurance companies in pursuance of the Act of December 18, 1984, No.
205, § 701 et seq., as hereafter amended, supplemented, modified or reenacted by the
General Assembly of Pennsylvania. Such monies received by the Township Treasurer
from the State Treasurer shall be distributed to the duly recognized association(s)
within 60 days of receipt. The funds shall be distributed on the basis of
the percentage of service established in the certification to the Auditor
General and with other provisions of the Act.
