The Hatfield Township Police Department and/or any other person(s)
designated by the Board of Commissioners for the enforcement of this
chapter (“enforcement officer”) are hereby empowered to
require the cessation, removal or abatement of any activity that is
determined to be a nuisance by any provision of the Hatfield Township
Code of Ordinances.
Where a person or entity is carrying on an activity that is
determined to be a nuisance by any provision of the Hatfield Township
Code of Ordinances, the enforcement officer shall first give five
days’ written notice to said person or entity to cease, remove
or abate the nuisance. Said notice shall be either served personally
on the offender or sent by certified mail, return receipt requested,
to the offender. If the nuisance is not ceased, removed or abated
within five days of the date of the notice, then the enforcement officer
is hereby authorized to take whatever steps are necessary to cease,
remove or abate the nuisance. The cost thereof, together with a 10%
penalty and all costs of prosecution as provided by law, shall be
collected by the Township as provided by law.
If a nuisance cannot be ceased, removed or abated by the enforcement officer, or if the enforcement officer determines to proceed without attempting to cease, remove or abate the nuisance, then the enforcement officer may file a civil complaint against the offender in Magisterial District Court. If found liable on the complaint, the offender shall be required to pay a fine not exceeding $600, plus court costs and attorneys’ fees. Each day that a violation continues after the date of the written notice required by §
188-2 of this chapter shall constitute a separate violation.
