It shall hereafter be unlawful for any person, association or corporation to collect or pick up from any other person, association or corporation within Whitpain Township, for compensation of any kind, any trash, rubbish or garbage without a permit first being obtained from the Supervisors of the Township.

Any person, association or corporation desiring to collect or pick up trash, rubbish or garbage in Whitpain Township for compensation of any kind must obtain a permit therefor on application to the Board of Supervisors and upon payment of an annual fee to be included in a schedule of fees as adopted and revised from time to time by resolution of the Board of Supervisors and on file in the office of the Township Manager. Said person, association or corporation may collect such trash, rubbish, refuse or garbage within the Township for a period of one year from the date of issuance of the permit.
Any person, association or corporation to whom a permit is so issued shall have the privilege of collecting any trash, rubbish or garbage to be picked up within the boundaries of Whitpain Township. Such permit shall provide only for the collection of such trash, rubbish or garbage but not for the disposal within the limits of Whitpain Township unless a municipal dumping site is provided. In the event a dumping site within the Township is made available for collectors in Whitpain Township, such dumping shall be done in accordance with a sanitary landfill operation and/or incineration as set forth in regulations adopted pursuant to this article.
No permittee shall dump any trash or rubbish in any dump owned, leased or operated by Whitpain Township, collected or picked up in any territory outside the boundaries of Whitpain Township, except as may be collected in any other municipality with which Whitpain Township may have an agreement at any time authorizing use of such dump in Whitpain Township for dumping of trash or rubbish collected in such other municipality.
Each permittee shall at all times while in the process of collecting, picking up or dumping said trash or rubbish have the permit, issued by the Supervisors, within the vehicle being employed in said collecting, picking up or dumping and shall exhibit the same, on demand, to any Township official.
The Supervisors of the Township shall have the right to refuse to issue a permit to any person, association or corporation or to revoke a permit previously issued if said permittee, his or its agents, servants and employees so load any vehicle or transport trash, rubbish or garbage within the Township in such a manner as results in trash, rubbish or garbage falling upon the public roads or upon lands abutting the public roads in the Township. All trucks collecting, picking up or dumping said rubbish, trash or garbage within the Township shall be covered with canvas or other suitable cover, and garbage shall be contained in leakproof containers to prevent the distribution of rubbish, trash and/or garbage upon the highways or upon abutting lands.

Any person violating any of the provisions of this article shall be guilty of a summary offense and, when convicted before a District Justice, shall be sentenced to pay a fine of not more than $600 and costs of prosecution or, in default of payment thereof, shall undergo imprisonment in the county jail for a period not exceeding 30 days.
