No boat propelled by gasoline or other motor power shall be operated upon Copake Lake in the Town of Copake in excess of six statute miles per hour between the hours of 8:00 p.m. and 9:00 a.m., inclusive.
Every boat propelled by gasoline or other motor power, operated or driven upon said lake within 1,500 feet from the shoreline thereof, shall be provided with a suitable and effective muffler of the underwater or other type to prevent unnecessary noise from exhaust gases, and the use of so-called "cut outs" is prohibited.
Every person operating a boat propelled by gasoline or other motor power within 1,500 feet from the shoreline of said lake shall at all times operate the same in a careful and prudent manner and in such manner and at such rate of speed as not to endanger the property of another or the life or limb of any person.
No boat propelled by gasoline or other motor power within 1,500 feet from the shoreline of said lake shall be operated in a reckless manner. Reckless operation shall include operating such boat in a manner which unnecessarily interferes with the free and proper use of the waters of said lake or unnecessarily endangers other craft thereon or the life or limb of any person.
No waterskiing or similar activity whereby persons riding skis or other devices are drawn behind vessels shall be permitted within any area of Copake Lake which may be designated a marina or swimming area by the Town Board of the Town of Copake and marked and defined by buoys placed in the waters of Copake Lake, and the operation of vessels other than those engaged in life saving or law enforcement under the direction of a public officer or unit or agency of government of the State of New York shall not be permitted within any area of Copake Lake which may be designated a swimming area by the Town Board of the Town of Copake and marked and defined by buoys placed in the waters of Copake Lake.

Every person, firm, corporation or other legal entity who shall provide for hire any boat propelled by gasoline or other motor power for use on said Copake Lake or who shall provide boat-launching facilities or boat-docking facilities at said Copake Lake shall deliver a copy of this article to all persons hiring said boats and to all persons using said launching facilities or said docking facilities. For purposes of the implementation of this section, copies of said article shall be available to those persons, firms, corporations or other entitles affected by this section at the office of the Town Clerk of the Town of Copake upon payment of a fee as may be set from time to time by resolution of the Town Board.

A. 
Any person, firm or corporation who is guilty of a violation of this article shall, upon conviction thereof, be subject to a fine of not more than $250 or imprisonment for a term of not more than 15 days, or both. Each day after notice that a violation continues shall be deemed a separate offense. In addition, a civil penalty of $100 per day may be assessed for any such violation, which civil penalty shall be recovered by the Town of Copake in a civil action.
B. 
Except as provided otherwise by law, such a violation shall not be a crime, and the penalty or punishment imposed therefor shall not be deemed for any purpose a penal or criminal penalty or punishment and shall not impose any disability upon or affect or impair the credibility as a witness, or otherwise, of any person found guilty of such an offense.
C. 
Appropriate actions and proceedings may be taken at law or in equity to prevent or remedy unlawful violations or infractions of any portion of this article, and these remedies shall be in addition to penalties otherwise prescribed by law.
This article supplements but does not supersede the statutes, rules and regulations of the State of New York concerning the use, operation and equipment of boats.
