Since it appears that many elected and appointed town officials and
town employees hold full-time or part-time employment aside from their work
for the Town of Cornwall and since the employers of these town officials and
employees are or may be vendors to the town of goods or services, in order
to avoid any appearance of impropriety and notwithstanding the provisions
of § 103 of the General Municipal Law, in no case will a voucher
for the purchase of goods and/or services from an employer of any elected
or appointed town official or town employee be approved unless:
A. The purchase is bid either formally in accordance with
§ 103 of the General Municipal Law or informally with written quotes
submitted as the Town Board shall determine; or
B. The Town Board shall by resolution authorize the purchase
of goods or services without informal bid, which resolution must be adopted
prior to the purchase. The Town Board shall not so authorize any purchase
unless it determines the goods or services to be so unique that the employer
of the town official or employee is the only source of supply for the goods
or services, such as Central Hudson.
