This chapter shall not apply to the operation or use of any organ, bell
or chimes by any church, synagogue or school when such instrument is used
during or in conjunction with a predetermined, scheduled activity.
If any party shall knowingly violate the provisions of this chapter
or engage in conduct in violation of this chapter, he shall be punished by
a fine not to exceed $250 or by imprisonment for not more than 15 days, or
both. Each incidence of any violation of a provision herein shall constitute
a separate offense.

A. A violation of this chapter shall be enforceable by any
law enforcement agency that has jurisdiction in the Town of Dover, the Code
Enforcement Officer of the Town of Dover, the Town Board of the Town of Dover,
or by the Town Attorney or his designee in the local Justice Court.
B. If a violation of this chapter shall occur in the presence
of any law enforcement officer having jurisdiction to enforce this chapter
or the Code Enforcement Officer, he shall issue an appearance ticket, as set
forth in §§ 150.10 to 150.75 of the Criminal Procedure Law,
based upon a written statement by the complainant.
C. In order to determine compliance with this chapter, the
Code Enforcement Officer is authorized, to the extent permitted by law, to
enter, inspect, and examine any building, structure, place, premises, or use
in the Town of Dover.
D. The Code Enforcement Officer or the Town Board may issue
a stop-work or cease and desist order and/or institute an appropriate legal
action or proceeding to prevent, restrain, correct, or abate any violation
of this chapter.
