A. 
This chapter shall be known as "A local law regulating and restricting the location, construction and use of buildings and structures and the use of land in the unincorporated area in the Town of Eden, County of Erie, State of New York," repealing the Zoning Ordinance of July 13, 1960, and all amendments thereto.
B. 
Short title. This chapter shall be known and may be cited as the "Zoning Ordinance of the Town of Eden, New York."

There is hereby established a new comprehensive zoning plan for the Town of Eden, which plan is set forth in the text and map that constitute this chapter. Said plan is adopted for the purposes set forth in Article 16, §§ 261 and 278, of the Town Law, which, in the interest of the protection and promotion of the public health, safety and welfare, shall be deemed to specifically include the following, among others:
A. 
To provide adequate development standards to ensure a balanced and orderly pattern of future growth and economic stability.
B. 
To encourage flexibility in the design and development of land in such a way as to promote the most appropriate use of lands, to facilitate the adequate and economical provision of streets and utilities and to preserve the natural and scenic qualities of open lands.
C. 
To ensure that future growth is coordinated with the town's ability to provide adequate municipal services.
D. 
To promote a safe and efficient circulation network that will serve the various types and intensity of pedestrian and vehicular traffic generated by future development within the town.
E. 
To protect, in their natural state, certain features of the town, including but not limited to forests, farmlands, wetlands, water bodies and streams, from filling, erosion and pollution.
F. 
To provide for the present and future residents of the town by encouraging the development of a balanced variety and quantity of sound housing opportunities for all segments of the population.
G. 
To ensure adequate land resources for agriculture, forestry, housing, industry, commerce and recreation.
H. 
To provide for the gradual elimination of nonconforming uses.
I. 
To protect and enhance the community's appearance.
J. 
To ensure the efficient and adequate provision of public facilities and services.
K. 
To protect residential areas and provide privacy for families.
