This article shall be known as the "Establishment of Two Alternate Zoning Board Members within the Village of Fair Haven."
This article is enacted pursuant to authorization by the New York State Constitution, Article IX, § 10, Subdivision 1(e)(3), of the provisions of the New York Municipal Home Rule Law.
In order to permit the Zoning Board to transact business in the event that absence or conflicts of interest preclude a full membership of five members from considering a particular matter, it is deemed advantageous by the Board of Trustees of the Village of Fair Haven to enact a local law to provide for the appointment of alternate members to the Zoning Board.
A. 
The Board of Trustees of the Village of Fair Haven shall appoint two alternate members to the Zoning Board to serve as provided in this article. The Chairman of the Zoning Board shall assign the alternate members as necessary when the absence of regular members of the Board or a conflict of interest of regular members of the Board would otherwise prevent five members of the Board from considering any pending matter. The alternate members shall be designated on a rotating basis so that each alternate member shall be afforded an equal opportunity to serve. Once designated to serve on a particular matter before the Board, alternate members shall have the same powers and duties as regular members of the Board until that matter is concluded. Any determination by the Board consisting of alternate members shall have the same weight and be entitled to the same authority as the act or deed of the regular Planning Board, and all laws, statutes and regulation shall apply and be applied with equal force and effect. Temporary members appointed pursuant to this section shall be paid for their respective services as fixed by resolution of the Board of Trustees.
B. 
Both alternate members shall serve for a term expiring at the end of the official year during which they are appointed, and their successors shall be appointed for a term of one year after the expiration of the terms of their predecessors in office. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by the Board for the unexpired term. The Board of Trustees shall have the power to remove any alternate member of the Zoning Board for cause and after a public hearing.
Both alternate members of the Zoning Board shall attend all meetings of the Zoning Board but shall have no power to participate in any actions of the Zoning Board except as provided herein.
