The purpose of this chapter shall be to contribute to the public safety and welfare through facilitation and enhancement of emergency service response within the Town of Farmington, by enforcing certain standards regarding the posting of address numbers.
A. 
Signs and number characteristics. All signs and address numbers required to be erected or posted herein shall be composed of letters or numbers which contrast substantially in color with the background of the material or sign to which they are attached, such as black letters or numbers on a white background. Numbers shall be composed of Arabic numerals. Apartment building, apartment complex, plaza and mall names shall be composed with a block-type font that is easily readable. Neither script nor italic fonts shall be used for either address numbers or apartment buildings, apartment complexes, plazas or malls.
B. 
Address numbers are required to be posted in one or more of the following manners:
(1) 
Rural mailboxes.
(a) 
Address numbers shall be posted on rural mailboxes when the mailbox is located on a public road or right-of-way in front of or directly across from the building the mailbox serves. Address numbers shall be a minimum of three inches high and shall be posted on both sides of the mailbox most nearly perpendicular to the public road or right-of-way. Address numbers so posted shall not be obstructed by the postal flag in either the upright or down position.
(b) 
Where obstructions limit visibility of the address numbers on the mailbox or where the character, materials or finish of a mailbox is incompatible with the posting of address numbers, property owners may either:

Attach address numbers to a mailbox support post, provided that the numbers are posted a minimum of 30 inches above grade and the post has a minimum width of three inches measured perpendicular to the street.
[2] 
Erect a freestanding sign for the posting of address numbers. Such a freestanding sign shall be erected in compliance with Subsection B(3) herein.
(2) 
On property where rural mailboxes are not used or are not present on a public road or right-of-way in front of a subject property, address numbers shall be posted on the principal building on the property. Numbers so posted shall be a minimum of four inches high and shall be posted on the side of the building facing the main access to the property, whether public or private, no more than 75 feet from the main access road.
(3) 
On property not located within an incorporated village, city or a municipal lighting district, and not served by a mailbox, curbside freestanding signs shall provide for the posting of numbers, a minimum of 30 inches above grade, and shall be located as close as reasonably practical to the intersection of the driveway serving the property with the public road or right-of-way. Where properties are accessed by private roads or rights-of-way which possess an official name recognized by the Ontario County Planning Department, such freestanding signs shall be located at the intersection of the driveway serving the property with the private road or right-of-way serving the property. Address numbers so posted shall be a minimum of three inches in height.
(4) 
Apartments.
(a) 
All apartments shall have the apartment or unit number posted on the entry door to each unit. Said apartment numbers must be mounted in the center of the door, between five and six feet up from the bottom of the door.
(b) 
Apartment buildings with fewer than 10 units shall have the address number assigned to the building posted in compliance with Subsection B(1), (2) and (3) above.
(c) 
Apartments with 10 or more units shall post a sign displaying the official name of the apartment building or complex as recognized by Ontario County. On property within an incorporated village, city or a municipal lighting district, such apartment building name signs shall be building-mounted in such a manner as to be clearly visible from the public road or right-of-way serving the property. Alphabetic characters used in such signs shall be a minimum of five inches in height. Such signs shall be posted a minimum of 60 inches above grade and shall not be obstructed by vegetation nor any building appurtenance.
(d) 
Apartment complexes with more than one building, or single apartment buildings located outside an incorporated village, city or municipal lighting district, shall display the official apartment complex name as recognized by Ontario County on a freestanding sign. Such freestanding sign shall be located as close as practical to the intersection of each driveway serving such a complex to the public road or right-of-way serving such a complex. Such signs shall be composed of alphabetic characters a minimum of five inches in height, shall be mounted a minimum of 60 inches above grade, shall be illuminated at night and shall not be obstructed by vegetation.
(e) 
Each building in an apartment complex with multiple buildings shall have, uniformly located, a single sign displaying both the building number, if any, and the range of apartment numbers in the building (for example: BLDG 1 APT 1-10, BLDG 2 APT 11-21). Such signs shall be located a minimum of 60 inches above grade, shall be illuminated at night, shall not be obstructed by vegetation nor any building appurtenance and shall be composed of characters a minimum of three inches in height.
(5) 
Malls and plazas.
(a) 
Each mall or plaza shall have a single, freestanding sign depicting the plaza or mall name as officially accepted by the Ontario County Planning Department. Such signs shall be illuminated at night and shall be composed of letters a minimum of five inches high and shall be located within 75 feet of the public road right-of-way, at or as close as practical to the entry drive or road to the plaza or mall.
(b) 
Each store within such a plaza or mall shall have its unique address number posted on all public entrances (in the case of malls, both exterior and interior public entrances shall be so marked). Such numbers shall be located a minimum of 60 inches above grade and shall be composed of characters a minimum of three inches in height.
(6) 
Commercial buildings. Each commercial building shall have its address number posted on all public entrances. Such numbers shall be located a minimum of 60 inches above grade, shall be composed of characters a minimum of six inches in height and shall be as close as practical to the entry drive or road to the commercial building. If there are multiple buildings, each building designation shall be posted on the public entrance to each building, such designation to be composed of characters a minimum of six inches in height. Buildings with multiple units within shall post, in addition to the aforementioned, the range of units (for example: Bldg. 1, Suites/Rooms 1-10) located within the building.
Each owner of real property located within the Town of Farmington shall be responsible for maintaining such property in compliance with this chapter.
A. 
Enforcement officer. The provisions of this chapter may be enforced by any officer of the Town of Farmington appointed to carry out such duties by the Farmington Town Board.
B. 
Commencement of proceedings. Any owner of real property which is found to be in violation of this chapter shall be issued an appearance ticket for such violation and shall be prosecuted in the manner herein provided.
C. 
Appearance tickets and process. Any person authorized to enforce this chapter may issue appearance tickets therefor and is hereby authorized to serve any process relating to any proceeding pursuant to this chapter. In the event that an appearance ticket is unanswered, the Justice Court shall permit the filing of the information from the appropriate enforcement officer and shall issue a warrant of arrest for the alleged violator.
D. 
Prosecution of violations. A violation of this chapter shall be punishable by a fine of not more than $25; except that, for a second violation of this chapter, the fine shall be not more than $50, and, for a third or subsequent violation of this chapter, the fine shall be not more than $100. Each week during which a property shall be found not in compliance with the posting standards set forth herein shall be deemed a separate and distinct violation of this chapter.
