Editor's Note: This local law also repealed former Art. I, Drainage District Entrance Fee, adopted 6-13-1978 by L.L. No. 3-1978 (Ch. 10 of the 1969 Code), as amended.
This article, upon adoption, replaces in its entirety Chapter 79 of the Code of the Town of Farmington and is entitled "Drainage District Entrance Fee Regulations."
There is hereby imposed upon each parcel of land located within the boundaries of the Town of Farmington Drainage District No. 1 a drainage district entrance fee charge; and such entrance fee charge is also imposed upon any lands located within said district extensions, which are improved by the construction or location of a building, structure or manufactured dwelling unit, or any addition(s) thereto upon such parcel of land.
A. 
No such drainage district entrance charge shall be imposed on a parcel of land for the construction of an agricultural-related building used in support of an agricultural operation, including but not limited to dairy barns, hay barns, silos, grain storage bins and farm machinery storage barns and sheds, nor for any additions thereto when the same are devoted to continued agricultural operations. However, any such agricultural-related building or addition thereto hereafter constructed, located or added to which ceases to be devoted solely to the ongoing agricultural operations shall thereupon be subject to a drainage entrance charge.
B. 
No such entrance charge shall be imposed for the construction of an addition to an existing residential dwelling, nor for the construction of a freestanding garage (an accessory structure) on a residential lot, or a garage addition to a residential dwelling, nor for a storage shed or storage building (accessory structures) on a residential lot, when the total ground area of disturbance for such addition, garage(s), shed(s) and storage building(s) is less than 25% of the ground area of disturbance for the residential dwelling, exclusive of such additions, garages, sheds and storage buildings.
A. 
The entrance fee charge shall be based upon an equivalent acre (EA) computed in the following formula. The entrance fee charge (EC) shall be that sum of money which is the product of multiplying the total acreage of development (AD) by the composite coefficient of runoff (CR), less the coefficient of undeveloped runoff (CU), times $1,800 per equivalent acre [EC = AD x (CR - CU) x $1,800].
B. 
The entrance fee charge formula cited above herein shall be subject further to the following considerations:
(1) 
Runoff will be determined by the use of the Rational Formula (see Design in Data Book for Civil Engineers by Elwyn E. Seelye, Third Edition).
(2) 
Undeveloped land shall have a coefficient of runoff (CR) of 0.10.
(3) 
The composite coefficient of runoff (CR) will be determined from the following formula: CR = Summation of the percent of portions of a land area times their individual coefficient of runoff.
(4) 
The following values shall be used as the specific coefficients of runoff (CR) of the respective land coverage:

C. 
The preceding formulas will be used for calculating the maximum drainage district entrance fee charge(s) for all commercial, industrial and residential developments, including single-family dwellings on residential lots located within a subdivision tract(s). However, the maximum drainage district entrance fee charge for a parcel of land or lot for a single-family dwelling located outside a subdivision tract as defined in Chapter 144 of the Town Code, entitled "Subdivision of Land," shall be a total of $200 per lot.
D. 
The Code Enforcement Officer and/or Town Engineer will compute the number of equivalent acres and the entrance fee charge for the specific project/development. The total entrance fee charge will then be divided by the total number of buildings to occupy the site to determine the unit entrance fee charge. The unit entrance fee charge shall be paid to the Town Clerk before a building permit may be issued.
E. 
Examples of determination of total and unit entrance fee charges.
(1) 
Given:
(a) 
A ten-acre parcel of land.
(b) 
A one-half-acre stormwater detention pond.
(c) 
Twenty building lots having a total square footage of roofs (which in this instance is one acre of roofs).
(d) 
A roadway, driveway and sidewalk network with a total square footage of hard surface areas (which in this instance is three acres of hard surface).
(e) 
The remaining 5.5 acres is represented by landscaped open space areas, lawns, etc.
(2) 
Computation of equivalent acreage:
