The purpose of this article is to ensure that the Transfer Station and the operations of solid waste collectors as defined in General Statutes § 22a-220a(g) conform to requirements of law.

It is the policy of the Town to make a maximum resource recovery effort, including but not limited to the recycling of corrugated cardboard, glass food containers, plastic containers, metal food and beverage containers, newspapers, office paper, scrap metal, storage (automotive) batteries, waste motor oil, and leaves, and, further, to empower the Board of Selectmen to authorize the Town Manager to contract with appropriate waste reduction companies or other persons or groups to effect the purposes of this article.

As used in this article, the following definitions of recyclable materials shall apply:
CARDBOARD
Corrugated boxes and similar corrugated and kraft paper materials which have a minimum of contamination by food or other material.
GLASS FOOD CONTAINER
A glass bottle or jar of any size or shape used to package food and beverage products suitable for human or animal consumption.
LEAVES
The foliage of trees.
METAL FOOD CONTAINER
An aluminum, bimetal, steel, tin-plated steel, or other metallic can, plate or tray of any size or shape used to package food and beverage products suitable for human or animal consumption.
NEWSPAPER
Used or discarded newsprint which has a minimum of contamination by food or other material, magazines and junk mail.[1]
OFFICE PAPER
Used or discarded high-grade white paper and manila paper, including but not limited to paper utilized for file folders, tab cards, writing, typing, printing, computer printing and photocopying, which is suitable for recycling and which has a minimum of contamination. For the purposes of §§ 22a-241b-1 to 22-241b-4 of the Regulations of Connecticut State Agencies, office paper generated by a household is excluded.
SCRAP METAL
Used or discarded items which consist predominantly of ferrous metals, aluminum, brass, copper, lead, chromium, tin, nickel, or alloys thereof, including but not limited to white goods and metal food containers.
STORAGE BATTERY
Lead acid batteries or other batteries used in motor vehicles such as automobiles, airplanes, boats, recreational vehicles, tractors and like applications.
WASTE OIL
Crankcase oil and antifreeze that has been utilized in internal combustion engines.[2]

There is hereby established a program for the mandatory separation of recyclable materials as defined in § 305-6 from municipal solid waste. Persons who utilize the Transfer Station or who privately contract for the collection of solid waste shall separate such recyclable materials from all other solid waste products and shall place such recyclable materials in separate bundles or containers in the appropriate location in accordance with this article and any regulations promulgated hereunder. No household trash, recyclable materials or hazardous waste shall be disposed of in the bulky waste area of the Transfer Station. The Town shall not accept or have collected solid waste which includes such recyclable material with solid waste or where the separated items are not placed for collection in accordance with this article or regulations promulgated hereunder.

The owner or occupant of each residence, residential unit, place of business, industry or institution shall keep the following items separate from other waste and place them in separate bins as provided by either a collector or at the Town of Hebron Transfer Station:
A. 
Newsprint, magazines and junk mail shall be bundled separately either in brown paper bags or twine and may be placed in the bin provided.
B. 
Glass food containers shall be rinsed and placed in the appropriate bins.
C. 
Metal food and beverage containers shall be rinsed and placed in the appropriate bins.
D. 
Corrugated cardboard shall be flattened and stacked in the appropriate bins.
E. 
Waste oil and antifreeze shall be placed in the tank provided at the Transfer Station.
F. 
Batteries shall be placed in the area provided at the Transfer Station.
G. 
Scrap metal shall be placed in the appropriate bin located in the bulky waste area of the Transfer Station.
H. 
Household hazardous waste materials are to be disposed of at the Capitol Region East Operating Committee (CREOC) facility.

The Hebron Transfer Station shall be open on such days and hours as determined by the Board of Selectmen.

Only residents of the Town of Hebron and home business uses may dispose of materials at the Transfer Center.

No person shall deposit at the Transfer Station refuse or bulky waste without displaying a resident sticker which is available at the Town Office Building. Each person applying for a sticker must show proof of residency and vehicle registration for the vehicle on which the sticker will be affixed and can only dispose of refuse or bulky waste originating within the Town of Hebron. There shall be a limit of two stickers per household.

The amount of the fee to be collected before a permit is issued shall be determined by the Board of Selectmen.

Each load of solid waste will be subject to inspection by the attendant prior to its being deposited at the Transfer Station. Failure to separate and process recyclable materials from other solid waste in accordance with § 305-8 of this article and any regulations promulgated hereunder shall constitute a violation of this article. Any offender shall be issued a written warning for a first offense and fined in an amount not to exceed $150 for each subsequent offense.

Any collector who has reason to believe that a person from whom he collects solid waste has discarded recyclable materials with such solid waste in violation of this article or any regulations promulgated hereunder shall promptly notify the municipal agent designated pursuant to General Statutes § 22a-220 of the alleged violation. Upon the request of the municipality, a collector shall provide a warning notice, by tag or other means, to any person suspected by the collector or municipality of violating separation requirements. A collector shall also assist the municipality to identify any person responsible for creating loads containing significant quantities of recyclable materials mixed with solid waste which are delivered to a resource recovery facility or solid waste facility by the collector and detected by the owner or operator of such facility pursuant to P.A. 90-220, Section 4(b).[2]

The Board of Selectmen is hereby authorized to promulgate regulations to implement this article and to amend or repeal the same from time to time.
