As used in this article, the following terms
shall have the meanings indicated:
The fee charged by and payable to the Borough Clerk of the
Borough of Essex Fells to obtain a permit as a landscaper to utilize
the Borough compost facility.
A person, persons, or firm which maintains, cuts, cleans,
rakes, or performs similar activities on property within the Borough
of Essex Fells for a fee or under contract.
All landscapers within the Borough of Essex
Fells shall be required to obtain a permit in order to utilize the
compost facility operated by the Borough of Essex Fells. A sticker
shall be required and displayed on each vehicle and/or trailer the
landscaper utilizes to deliver material to the Borough compost facility.
A.
All applications for a compost facility use permit
shall be in writing on forms furnished by the Borough, signed by the
applicant or the authorized agent of the applicant, and presented
to the Borough Clerk. The application shall list the name of the landscaper;
the correct name under which the business is being operated; the address
and phone number of the landscaper; the names and addresses of the
residents of the Borough for whom landscaping services are being provided;
the year, make, model and license plate number of the vehicle or vehicles
being utilized to deliver material to the compost facility; and such
other pertinent information as may be necessary.
B.
All applications for permits received by the Clerk
shall, after appropriate review, be granted or refused. Thereafter,
if the application is approved, the Borough Clerk shall issue the
permit upon payment of the permit fee hereinafter provided.
C.
All permits shall expire March 31 of the year following
the year of issuance.
Every landscaper operating within the Borough
who desires to utilize the Borough composting facility shall be required
to comply with the following:
A.
The name of the landscaper and the municipality where
he resides shall be clearly indicated on both sides of any vehicle
used to deliver material to the compost facility.
B.
The disposal of cuttings, clippings, or waste materials
from sites outside Essex Fells is prohibited within the compost facility.
A.
Upon filing of such application, the applicant shall
pay to the Borough Clerk a fee of $50 which will entitle the applicant
to one or two decals, depending on the number of vehicles registered.
Any additional decals required shall cost $10 each. Any fraction of
a year will be considered a full year for the purposes of this section.
B.
The term of such permit shall be from April 1 to March
31 of the following year.
