This chapter shall be known as the "South Strabane Township Outdoor Fire Burning Ordinance" and is intended to regulate the outdoor burning of trash, leaves, paper and other organic materials. However, these regulations shall not apply to fires used in connection with camping, cooking, picnicking or recreation activities.
No such fire shall be permitted to burn except on Wednesdays, between the hours of 4:00 p.m. and 8:00 p.m., and Saturdays, between the hours of 12:00 noon and 8:00 p.m.; provided, however, that such fires may be permitted on other days, provided that notice is given and permission granted by the Township Manager after clearance with the Township Fire Department, and provided that such burning shall not be permitted on Sundays and holidays.
Burning of trees not in excess of 12 inches in diameter and brush incidental to the development of land or the construction of buildings is permitted, provided a permit is obtained from the Township upon written application by the developer. Said application shall contain a description of the property to be developed, its area and location. The Township Manager shall make a determination from the facts contained in said application whether the use of a DEP-approved air curtain destructor is required.
Fires shall not contain any garbage, any material made of or coated with rubber, plastic or petroleum-based materials and shall not contain any flammable or combustible liquids.
Any person, firm or corporation who shall violate or fail to conform to any of the provisions of this chapter shall be subject to the penalties provided in §
1-2, Summary proceedings, of the Code of the Township of South Strabane.
