[Adopted 3-27-2007 by Ord. No. 4-2007]
Building and construction activity, or any activity
related thereto, which takes place in an industrial or commercial
zoned area shall be conducted between the hours of 7:00 a.m. and 7:00
p.m., Monday through Saturday. Additional work hours may be added
upon the approval of the Board of Supervisors only, and said approval
may include restrictions or conditions to assure that such hours of
operation do not unreasonably disrupt the tranquility or integrity
of the various neighborhoods in the Township or surrounding communities
or that such is not adverse to the health, safety and welfare of the
residents of South Strabane. Violation of any restriction or condition
placed by the Board of Supervisors may cause the grant of additional
hours to be revoked or modified.
At least 72 hours prior to the public meeting
to be held by the Board of Supervisors to consider a request for additional
hours, written notice of said meeting and request shall be sent by
the Township, by first-class mail, to the addresses to which real
estate tax bills are sent for all real property within 300 feet of
the property line boundaries of the real property upon which such
requested hours of work will take place. Names and addresses shall be provided by the party submitting
the request. Costs associated with mailing said notice shall be borne
by the party making the request.
All construction or building activity within the Township must comply with the standards set forth in Chapter
148, Noise and Dust, of the Code of the Township of South Strabane, as well as any other applicable ordinance.
In the event of an emergency which affects the
public health and safety, construction or building activity outside
of the hours and days regulated above may occur, but, if possible,
shall only occur after approval from the Township Zoning Officer or
Township Code Enforcement Officer.
In addition to any available Township remedy, including but not limited to a cease and desist order, any person, firm, corporation, association or entity which violates the provisions of this article shall be subject to the penalties provided in §
1-2, Summary proceedings, of the Code of the Township of South Strabane.
