This article is adopted under the authority
granted by Article 89 of the amendments to the Massachusetts Constitution
(the "Home Rule Amendment").

No roadway shall be voted upon for acceptance
by the town unless such roadway has been first determined by the Select
Board and Planning Board to be in compliance with the following minimum
design and construction requirements:
A. Design requirements. Compliance with the minimum design requirements for streets, according to street type, as defined by Chapter
70, Zoning, and specified in Ch.
170, Subdivision Rules and Regulations, in effect at the time the roadway is proposed for acceptance, except insofar as such requirements have been expressly waived by the Planning Board, and where the Select Board concur with such waivers, in writing, at the time the roadway is proposed for acceptance.
B. Construction standards. Compliance with the applicable
Williamstown Department of Public Works Road Construction Standards, in effect at the time the roadway is proposed for acceptance,
except insofar as such standards may have been expressly waived by
the Planning Board, and where the DPW Director and Select Board concur
with such waivers, in writing, at the time the roadway is proposed
for acceptance.
C. Minor lanes. A roadway approved and constructed as a minor lane under the minor lane residential development provisions of Chapter
70, Zoning, and Chapter
170, Subdivision Rules and Regulations, shall be deemed not to comply with the minimum design and construction standards described above and shall not be voted upon for acceptance by the town until such time as the roadway has been brought into compliance with the applicable Subdivision Rules and Regulations for lanes and the Department of Public Works Road Construction Standards in effect at the time the roadway is proposed for acceptance, except as expressly waived under Subsections
A and
B above.
