For the purposes of this chapter, the following
terms shall have the meanings indicated:
SKATEBOARD
A single platform which is mounted on wheels, having no mechanism
or other device with which to steer or control the direction of movement
thereof while being used, operated or ridden.
No person shall engage in the reckless operation of roller skates,
in‐line skates, or a skateboard. Further, no person shall use,
operate or ride on any skateboard in any other place within the Village
of Fairport in such an unsafe or dangerous manner as to put himself,
herself or others in danger of death or serious bodily injury.
No person shall use, operate or ride upon any
skateboard in any public park or public parking lot or public parking
garage within the Village of Fairport, or on Main Street between the
most southerly railroad track which crosses Main Street in the Village
and the intersection of South Main Street with East and West Church
Streets, or on the sidewalk on either side of Main Street between
said most southerly track and said intersection. Further, no person
shall use, operate or ride on any skateboard in any other place within
the Village of Fairport in such an unsafe or dangerous manner as to
put himself, herself or others in danger of death or serious bodily
injury.
Any violations of this chapter shall constitute
an offense. Any police officer who shall observe any person using,
operating or riding upon a skateboard in violation of this chapter
shall take possession of the skateboard. In the case of a first offense,
if the rider is less than 16 years of age, the skateboard will be
returned to the rider when accompanied by his or her parent or guardian
at the Fairport Police Department. In the case of a second offense,
the skateboard shall be taken from the rider and not returned to him
or her for 15 days, upon appearance at the Fairport Police Station
as aforesaid. In the case of a third offense, the skateboard shall
be taken from the rider, forfeited to the Village of Fairport and
destroyed. Any rider over the age of 16 years violating these provisions
constitutes an offense and shall be subject to a twenty-dollar fine
for the first offense and a thirty-dollar fine for the second offense.
