Sidewalks are required on all properties in the Village of Hamburg along all adjoining public streets except on properties on so-called dead-end streets. To the maximum extent practicable, sidewalks shall be installed within the street right-of-way at the street right-of-way line and shall extend the entire length of the street right-of-way.

A. 
Required sidewalks shall be installed and repaired at the expense of the respective property owners, except in the case of a property adjoining more than one public street, only the sidewalk installed along the longer street right-of-way line shall be installed and repaired at the expense of the property owner, and the sidewalk installed along the shorter street right-of-way shall be installed and repaired at Village expense.
B. 
The owner or occupant of any premises fronting or abutting any street or highway shall repair, keep safe and maintain any sidewalk abutting the premises and keep it free and clear from snow, ice, dirt or other obstruction. Any such owner or occupant shall be liable for any injury or damage by reason of omission or failure to repair, keep safe and maintain such sidewalk or to remove snow, ice or other obstruction therefrom, or negligence in performing those functions.
C. 
No person shall plow, shovel, sweep or pile snow, ice or other materials in or on any sidewalk, street, or public highway or cause such to be done so as to interfere with the safety and convenience of public travel.
D. 
No person shall remove snow or ice from any parcel or property and place it upon another parcel or property without the express permission of the owner of the parcel upon which the snow or ice is to be placed.
E. 
Snow and ice shall be removed within 24 hours after the end of a snowfall. In addition, sidewalks in front of commercial establishments and along commercial parking lots shall be kept free of snow and ice at all times between the hours of 9:00 a.m. and 5:00 p.m.
F. 
In case snow or ice on any sidewalk shall be frozen so hard that it cannot be removed without injury to the sidewalk, it shall, within the time specified within this article, be strewn and kept strewn with sand, salt, or other suitable commercial snow and ice melting products, so as to no longer be dangerous to life and limb. As soon as practical thereafter, the sidewalk shall be completely cleared of snow and ice and other materials strewn thereon, as provided in this article.
G. 
The owners or occupants of buildings adjacent to public sidewalks shall take measures to protect the public from falling snow, ice or water from such buildings.
Where an asphalt surface has been heretofore installed in a location where a sidewalk would otherwise be located, such surface may be used for sidewalk purposes, provided that it is in good condition and is at correct grade and elevation with respect to sidewalks on adjoining parcels. Asphalt sidewalks shall not be resurfaced with asphalt. They may be replaced only with concrete sidewalks installed in accordance with Village specifications. In the case of newly annexed property up to five years grace to be granted for construction of the same.
A. 
With respect to the repair, replacement and realignment of public sidewalks in the Village of Hamburg, the following shall be the policy of the Village of Hamburg, effective April 16, 1990. Following a receipt of a notice to repair or replace designated sidewalks, the owner or occupant of the affected property may proceed as follows:
(1) 
Sidewalk slabs marked for replacement must be replaced.
(2) 
Sidewalks out of alignment by more than 3/4 inch with adjacent slabs of sidewalk must be replaced. However, the resident may elect to raise or lower the appropriate slab of sidewalk and must advise the Village for inspection.
(3) 
Sidewalks that have a two-inch drop or rise in 10 feet must be replaced. However, the resident may elect to raise or lower the appropriate slabs of sidewalk and must advise the Village for inspection.
(4) 
Should the resident advise the Village that he or she wishes to do the work himself or herself, and the work is not completed by the time the contractor starts work for the Village, that work will be completed by the contractor and the appropriate amounts billed to the resident.
(5) 
Sidewalks with single or multiple cracks rendering the slab structurally inadequate must be replaced.
(6) 
Slabs adjacent to sidewalk being removed that are cracked will have to be removed if further damage occurs.
(7) 
The decision as to what slabs will be replaced will be at the sole discretion of the Department of Public Works.
(8) 
The costs incurred by the Village for replacement of any sidewalk pursuant to this section shall be billed and assessed to the homeowner. Should any amount of said bill be due and owing, including any late fees, as of December 31 of the year in which the bill was issued, the specified assessment and penalty shall be added to the property tax roll.

B. 
Village contractors are not authorized to repair or realign sidewalks or sidewalk slabs. Village contractors will in each and every instance replace (not repair) affected sidewalks.

Any person committing an offense against any of the provisions of this article shall be guilty of a violation and, upon conviction thereof, shall be punishable by a maximum fine of $250 or by a term of imprisonment of not more than 15 days, or both.
