A. The Board of Trustees of the incorporated Village of
Old Westbury recognizes that it has an aesthetic and economic obligation to
preserve and improve the appearance of the Village.
B. It has become apparent that the accumulation of signs
posted on public property within the Village has resulted in an intrusive,
unpleasant and adverse impact upon the natural and functional beauty of the
Village as well as its inhabitants. Specifically, the accumulation of signs
posted in various locations creates a potential safety hazard in that they
block views and otherwise cause traffic hazards through motorist distraction.
Additionally, the Village has an interest in protecting the safety of workmen
who must scale utility poles in order to remove these signs.
C. The accumulation of signs posted on public property constitutes
visual clutter throughout the Village, and the Village recognizes that it
is within its power to prohibit such postings in order to achieve the aforementioned
objectives.

A. It shall be unlawful for any person, firm or corporation
to erect, affix or maintain a sign, whether political, noncommercial or commercial
in nature, upon any public property within the Incorporated Village of Old
Westbury. This prohibition shall also include any and all freestanding signs.
B. All signs in existence on the effective date of this
section shall become prohibited, and unlawful structures shall be removed.

No person shall operate any musical instrument or broadcast from motor
vehicles, airplanes or dirigibles or permit or cause any noise to be made
for advertising purposes or for the purpose of attracting attention to any
exhibition, show or for any other purpose, unless a permit shall have been
obtained from the Village Clerk, the fee for which shall be $25.

Any person violating any provision of this chapter shall pay a fine
not to exceed $50 for a first offense and a fine not to exceed $100 for a
second and each succeeding offense. In addition, each such violation shall
constitute disorderly conduct, and any person violating the same shall be
a disorderly person.
