A. Every person convicted of a traffic infraction for
a violation of any provision of this chapter or of Chapter 278 of
this Code which is not a violation of any provision of the Vehicle
and Traffic Law of the State of New York shall, for a first conviction
thereof, be punished by a fine of not more than $50 or by imprisonment
for not more than 15 days, or by both such fine and imprisonment;
for a second such conviction within 18 months thereafter, such person
shall be punished by a fine of not more than $100 or by imprisonment
of not more than 45 days, or by both such fine and imprisonment; upon
a third or subsequent conviction within 18 months after the first
conviction, such person shall be punished by a fine of not more than
$250 or by imprisonment for not more than 90 days, or by both such
fine and imprisonment.
B. Every person found guilty of a parking violation arising
out of the provisions of this chapter or of Chapter 278 of this Code
shall be subject to the fines as hereinafter set forth together with
the penalties for late payment. The application of penalty days shall
commence on the first day following the date set forth on the parking
ticket or uniform traffic summons. If the 15th day or 30th day shall
fall on a day when the City municipal offices or the City Court shall
be closed, the fines paid on the next business day shall be deemed
to have been paid on the date when the City offices were last open
for business. The fines to be paid to the City Chamberlain shall be
set by resolution from time to time by the Common Council of the City
of Oneonta.
