A. 
Parking meter zones are hereby established upon the streets as described in Schedule XIX (§ 244-101), attached to and made a part of this chapter, between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday, except legal holidays.

B. 
Rates.
(1) 
Meters utilized by use of coins of credit cards. The rates for long-term meters shall be $0.25 per hour, with two-hour minimum increments. The rate for short-term meters shall be, when paid by credit card, $1.15, with a one-hour minimum transaction required, and when paid by coin, $0.05 for four minutes, $0.10 for eight minutes, $0.15 for 12 minutes, $0.35 for 28 minutes and $0.75 for one hour. The rate for limited-term meters shall be $0.25 per 1/2 hour with six-minute increments at $0.05 each and twelve-minute increments at $0.10 each. Long-term meters shall have maximum time periods of two hours. Limited-term meters shall have maximum time periods of 1/2 hour. Short-term and long-term meters shall have a device permitting a user to access the initial fifteen-minutes period without charge, excepting, however, short-term and long-term meters governing designated handicap parking spaces shall have a device permitting a user to access the initial thirty-minute period without charge. Limited-term meters shall allow no free parking.

(2) 
Meters utilized by cellular telephones or other similar compatible digital means. The Borough reserves the right from time to time to provide as a convenience to those persons parking within designated parking meter zones the use of metered parking spaces by applications operated by use of a cellular telephone or other digital means. The use of metered parking spaces by digital means shall be based upon rates established by the Borough through agreement with the approved service provider or providers. The users of this service shall be responsible for paying both transaction convenience fees to the service provider and the Borough as well as an applicable parking rate that will be transmitted to the Borough by the service provider. The convenience fees to be charged may be changed from time to time based upon the costs incurred by the Borough for credit card transactions and the cost for the service as charged by the approved service provider or providers.

Parking meters installed in the parking meter zones established in § 244-31 of this article shall be placed upon the sidewalk and immediately adjacent to the individual parking spaces hereinafter described. Each parking meter shall be placed or set in such manner as to show that the parking space adjacent to such meter is or is not legally occupied. Each parking meter installed shall indicate by a proper legend the legal parking time established by the Borough and, when occupied, unless appropriate payment has been made by digital means, shall indicate on and by its dial and pointer the duration of the period of legal parking and, on the expiration of such period, shall indicate illegal or overtime parking.
It shall be unlawful and a violation of this article for any person to permit a vehicle to remain in any parking space adjacent to a parking meter when such meter shall display a signal indicating that such vehicle shall already have been parked beyond the period of time prescribed for such parking space.
Each hour that a vehicle shall continue to be parked overtime in any parking meter zone after the adjacent parking meter shall indicate a violation applicable to such vehicle shall constitute a separate violation of the overtime parking provisions of this article.

Notwithstanding any applicable state law relieving a driver of a vehicle being operated by or for the transportation of a handicapped person or severely disabled veteran of liability for parking for a certain time in excess of the legal parking period under certain circumstances, the deposit of proper coins shall be required for all such use. It shall be unlawful and a violation of this article for any person to permit a vehicle to remain parked in a metered space without depositing one or more proper coins of the United States as shall be specified in the legend upon such parking meter when the meter indicates by signal that the deposit of such coins is required to continue lawful occupation of such metered space.
It shall be unlawful and a violation of this article for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article. Nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or police officers of the Borough under the directions of the Mayor and/or the Borough Council.
A. 
It shall be the duty of the police officers of the Borough, acting in accordance with instructions of the Chief of Police, to report:
(1) 
The number of each parking meter that indicates that the vehicle occupying the parking space adjacent thereto is or has been parked in violation of any of the provisions of this article.
(2) 
The date and hour of such violation.
(3) 
The state license number of such vehicle.
(4) 
Any other facts, the knowledge of which shall be necessary for a thorough understanding of the circumstances attending such violation.
B. 
Every police officer shall also place upon such vehicle a notice that such vehicle was parked in violation of this article, which notice shall contain instructions to the owner or driver of such vehicle that, if he or she shall pay, for the use of the Borough, the sum of $15 within 10 days after the time of such notice, or the sum of $20 if paid after 10 days, the same shall save the violator from prosecution and from the additional payment of the costs of prosecution. Payment shall be made by United States Mail to the office of the Finance Director, in person at the Borough Hall, at the drop box at either the Borough Hall or the Police Department or by online Internet payment. The owner or driver shall be liable for the necessary postage if he or she mails such amount; provided, however, that for each additional notice of violation by the same vehicle within the same parking space in the same twenty-four-hour period, the required payment within 10 days after the time of such notice shall be the sum of $10 to save such violator from prosecution.

C. 
For purposes of this section and article, meter attendants employed by the Borough for the purpose of policing the use of parking meters are authorized to enforce the parking laws and are included within the definition of “police officer.”
Any person violating any provision of this article, except for § 244-36 thereof, shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not less than $10 nor more than $20 and costs of prosecution, and in default of payment of such fine and costs, to undergo imprisonment for not more than five days. Any person who shall violate any provision of § 244-36 of this article shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not more than $50 and costs of prosecution, and in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.
A. 
Meter hoods for tradesmen.
(1) 
Upon proper written application, the Mayor or Chief of Police may issue hoods for parking meters to tradesmen who perform their work within the Borough for use in the furtherance of the work of their trade by permitting parking of their trade vehicle near the work when required thereby to utilize tools and equipment of their trade. Either an annual fee or a daily fee for the use of theme hoods by tradesmen is hereby authorized and shall be as set forth in Chapter 120, Fees, as enacted and ordained, and as may be, from time to time, amended. All hoods shall be numbered and identified with the tradesmen to whom they were issued.
(2) 
Any tradesman to whom such hood shall have been properly issued may place said hood upon any parking meter on the public streets or alleys of said Borough adjacent to the premises on which he or she is performing his or her trade, and may park the vehicle being used in the performance of his or her trade in said parking space without the payment of any meter fee during the period of the actual performance of his or her trade. This privilege shall not extend to any vehicle parked while tradesmen are located in their normal place of business. The privilege is available only while practicing the trade at locations separate and distinct from the normal place of business. This privilege shall only extend to trade vehicles bearing proper business lettering designating it as a trade vehicle.
(3) 
The hoods and privileges granted hereby shall be valid only during the calendar year in which they were properly issued. The word "tradesman" shall include any person, firm, corporation or partnership pursuing a trade, and the word "trade" shall include only skilled manual or mechanical work.
(4) 
Penalty for violation. Any person or persons, firm or corporation violating any of the provisions of this section or improperly making use of any hood shall, upon summary conviction, be sentenced to pay a fine of not less than $5 nor more than $25, together with costs of prosecution, which fine and costs shall be recoverable as debts of like amount are by law recoverable. In default of the payment of said fine and costs, where such default is not caused by indigency, a person convicted hereunder shall be committed to the Cumberland County Prison for a period not exceeding 10 days. Said hood previously issued to said tradesman shall be revoked.
B. 
Exemptions for jurors. Notwithstanding any other provision of this Article IV, it shall not be unlawful for a person during a time of actual jury duty with the Court of Common Pleas of Cumberland County, Pennsylvania, to permit his or her vehicle to remain in a parking space adjacent to a meter on any street or off-street metered space without payment of parking meter charges, provided that:

(1) 
There are no available parking spaces in the Pomfret Street Parking Garage;
(2) 
The Borough shall have arranged for compensation for such dispensation to be received from the County of Cumberland;
(3) 
A permit or similar indication authorized by the Borough shall be prominently displayed upon the vehicle, evidencing the juror’s status;
(4) 
Such parking shall be otherwise permitted; and
(5) 
No juror shall park in the West Louther Street (North) parking lot.
