There is hereby created for the Township of College a Planning Commission
consisting of seven members, pursuant to the Pennsylvania Municipalities Planning
Code, Act of July 31, 1968, P.L. 805, Article II, §§ 101, 201
et seq. (53 P.S. § 10101, 10201 et seq.).
The Township Council shall be the appointing authority and shall have
power to appoint, reappoint or replace members of the Planning Commission
who are, in the opinion of the appointing authority, qualified for the duties
of their positions, for such terms as are not inconsistent with this chapter
and with the Pennsylvania Municipalities Planning Code.
The members shall hold office for terms of no longer than four years;
provided, however, that members first appointed, reappointed or replaced shall
be appointed, reappointed or replaced for terms so that no more than two members
shall be appointed, reappointed or replaced in any single calendar year.
All members shall reside in the Township of College, and at least five
members shall be designated as citizen members and shall not be officers or
employees of the Township of College.
The Planning Commission shall have all the powers and duties provided
for by law now or as hereafter amended, especially including but not limited
to the powers and duties contained in the Pennsylvania Municipalities Planning
Code, including the amendment to such Code enacted as the Act of June 1, 1972,
P.L. 333, No. 93, § 209.1 (53 P.S. § 10209.1), and to
expend funds consistent with the purposes of the creation of the Planning
Commission, but in no case in any one year to expend in excess of the budgeted
appropriations.
All powers granted by law shall devolve upon and become the functions
of such Planning Commission, which said Commission shall cooperate with any
Regional Planning Commission and County Planning Commission now in existence
or that may hereafter be created.
