The intent of this chapter is to promote the general health, welfare and safety of the community.
Franklin Township hereby elects to implement the Pennsylvania Construction Code Act (the "Act") (35 P.S. § 7210.101 et seq., as amended) and the Uniform Construction Code ("UCnC") as provided in 34 Pa.Code § 401.1 et seq., as amended from time to time. The said Uniform Construction Code is hereby adopted by reference thereto as the building code of Franklin Township.
Administration and enforcement of the UCnC within Franklin Township shall be undertaken in any of the following ways as determined by the Board of Supervisors from time to time by resolution:
A. 
By the designation of an employee of the Township to serve as the municipal code official to act on behalf of the Township;
B. 
By the retention of one or more construction code officials or third-party agencies to act on behalf of the Township;
C. 
By an intergovernmental cooperation agreement with one or more other municipalities for the joint administration and/or enforcement of part or all of the UCnC;
D. 
By entering into a contract with another municipality for the administration and/or enforcement of part or all of the UCnC; and/or
E. 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of the UCnC for structures other than one-family or two-family dwelling units; utility structures; and miscellaneous structures.
A Board of Appeals, in conformity with the Act, shall be established by a resolution of the Board of Supervisors. The Board of Appeals shall carry out the functions prescribed in the Act and in the UCnC.

Editor’s Note: Ordinance No. 2005-02, adopted 5-5-2005, authorized the Board of Supervisors of Franklin Township to enter into an intermunicipal agreement creating a Shared Adams County UCC Board of Appeals. The full text of the agreement is on file in the Township offices.
All fees related to the administration and enforcement of the UCnC shall be prescribed by a resolution of the Board of Supervisors, as may be adopted from time to time.
All amendments, supplements, revisions or other changes to the UCnC shall be applicable in Franklin Township upon the effective date of such change.
Any provision of any other law or code notwithstanding, no building permit and no certificate of occupancy shall be issued unless there has been compliance with the land use laws and ordinances of the Township (including but not limited to subdivision, land development and zoning) and with the sewage disposal laws and ordinances of the Township.
Nothing in this chapter shall affect the requirement to obtain permits pursuant to any other law or ordinance regulating the development of land and the use of land.
