As used in this article, the following terms shall have the meanings indicated:
OWNER
Shall have the meaning set forth in § 43-1 of the Code of the Borough of Glenolden.
PIT BULL
Includes any of the following breeds and/or types of dogs: Staffordshire terrier, American pit bull, pit bull, any dog that fits into the above American Kennel Club definitions, which displays the majority of the vicious traits of any of the above breeds, and any dog bred or trained for fighting.
Pit bulls are considered dangerous dogs which are potentially hazardous to the community and its residents. The purpose of this article is to regulate the licensing, ownership, keeping, harboring, care, confinement and destruction of dogs with dangerous propensities in an effort to safeguard and promote the health, safety and welfare of the community and its residents.
Pit bulls shall at no time and under no circumstances be permitted to run loose within the Borough of Glenolden. Any pit bull running loose within the Borough of Glenolden shall be subject to restraint, confinement, impoundment and/or destruction by any Borough police officer or other person authorized by the Borough. It shall be the duty of any Borough police officer or other person authorized by the Borough to take whatever action is necessary under the circumstances to properly secure and restrain any loose pit bulls, including immediately destroying the dog, and any Borough police officer or other person authorized by the Borough is hereby authorized to take such action.
A. 
License required. No person shall own, keep or harbor any pit bulls over six months of age in any household, residence or on any property whatsoever within the Borough without first obtaining a pit bull license from the Secretary of the Borough of Glenolden.
B. 
Application for license. Applications for a pit bull license shall be filed with the Borough Secretary, shall provide the following information and shall be accompanied by the bond required in Subsection G hereof:
(1) 
The name of the applicant.
(2) 
The name of the owner of the pit bull, if different from the applicant.
(3) 
The address where the pit bull will be kept.
(4) 
The number of pit bulls to be kept or housed on the premises.
(5) 
The exact location on the property where the pit bull(s) will be kept.
(6) 
The method to be used to secure or restrain the pit bull(s) on the property.
(7) 
The name of the person who will be responsible for the care and confinement of the pit bull(s).
(8) 
Any other information requested by the Borough.
C. 
Application fee. All applications shall be accompanied by an application fee of $50 for each pit bull for which a license is being sought, which application fee is nonrefundable. The fee includes the cost of processing the application and of any inspection made prior to licensing.
D. 
Compliance with law. Pit bull licenses shall be issued by the Borough Secretary only after the appropriate fees have been paid and only if the applicant has complied fully with all applicable laws.
E. 
License fees. The pit bull license fee shall be $500 per dog per year.
F. 
Revocation of license. If the applicant, owner or other person responsible for any pit bulls kept within the Borough violates any provision of this article or any other applicable law, then any license issued hereunder shall automatically be revoked, and the license fee shall be retained by the Borough.
G. 
Bond requirement. Any person who owns, keeps or harbors a pit bull must post a bond of $20,000 with the Borough of Glenolden to ensure payment of any damages or injuries which might be caused by said pit bull.
A. 
All pit bulls must be confined in a secured building or enclosure.
B. 
Pit bulls may not be kept, housed or harbored in an exterior yard unless they are securely leashed and muzzled at all times and unless the exterior yard is securely fenced by a fence which complies with all applicable provisions of the Code of the Borough of Glenolden.
C. 
All owners of pit bulls must post a warning sign or signs on the property where the pit bull is kept, housed, harbored or confined. The size, type and location of said sign(s) must be approved by the Borough Secretary, and the sign(s) shall, in all respects, comply with all applicable provisions of the Code of the Borough of Glenolden.
D. 
Any pit bull which is taken off or removed from the owner's property must be kept securely leashed and muzzled at all times.
Any pit bull which bites or attacks a person within the Borough of Glenolden must be destroyed at the owner's expense or permanently removed from the Borough of Glenolden within three days after said biting or attack. If said pit bull is not removed from the Borough or destroyed within three days after said biting or attack, the pit bull shall be subject to seizure and/or destruction by the Borough or its duly authorized agent.
A. 
Any person violating any provision of this article shall be subject to the penalties set forth in § 43-10 of the Code of the Borough.
B. 
In addition, any person violating the provisions of this article shall be subject to the following;
(1) 
Forfeiture of his or her bond.
(2) 
Revocation of his or her pit bull license and retention of the license fee by the Borough.
(3) 
Prohibition from obtaining another pit bull license for up to five years.
Articles I and II of Chapter 43 of the Code of the Borough shall apply to pit bulls. However, to the extent that any such provisions or any other Code provisions are inconsistent with the provisions of this article, the provisions of this article shall control.
