This article shall be known as the "West Goshen
Sewage Disposal Ordinance of 1968."
As used in this article, the following terms
shall have the meanings indicated:
SEWAGE
All matter commonly referred to as sewage or defined as sewage
by any statute of the commonwealth, including but not limited to human
excrement, garbage, decaying matter, industrial or household waste
and kitchen and laundry water.
The following acts are hereby declared to be
detrimental to the public health and are prohibited:
A. Construction, maintenance or use of any privy, cesspool,
urinal or other receptacle for sewage which directly or indirectly
overflows, drains or discharges over or upon the surface of the ground
or into ditches or any creek, stream, river, gutter, street or roadway
or which does or may attract flies.
B. Discharge of sewage onto or the accumulation of sewage
on any street, road or public place or any creek, stream or river
or any private property.
The proper disposal of sewage by any means or method authorized by statute of the commonwealth or ordinance of this Township is excepted from the provisions of §
66-17 hereof. In any prosecution under this article, the burden of proving an exception shall be on the defendant.

Any person who violates or permits the violation
of any provision of this article shall, upon conviction thereof in
a summary proceeding brought before a District Justice under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense, and shall
be subject to the payment of a fine of not less than $100 and not
more than $1,000, plus the costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment in the county
prison for a term of not more than 30 days. Each section or provision
of this article that is violated shall constitute a separate offense,
and each day or portion thereof in which a violation of this article
is found to exist shall constitute a separate offense, each of which
violations shall be punishable by a separate fine imposed by the District
Justice of not less than $100 and not more than $1,000, plus the costs
of prosecution, or upon default of payment thereof, the defendant
may be sentenced to imprisonment in the county prison for a term of
not more than 30 days. All fines and penalties collected for the violation
of this article shall be paid to the Township Treasurer.
