All kitchens, rooms and other places within
the Town wherein food is prepared by heating and/or cooking for ultimate
sale to, or consumption by the general public shall be equipped at
all times while in operation with fire-extinguishing equipment or
apparatus containing the chemical formula CO2 in good working order for use at any time and of sufficient size
and quantity, as may reasonably be required to extinguish possible
fire resulting from the use and operation of the heating and/or cooking
equipment in use in any such kitchen, room or place.
The Fire Marshal of the Town shall inspect all such kitchens, rooms and other places within the Town where food is prepared and the fire-extinguishing equipment or apparatus required by § 121-4 at least once in every three months while such establishment is in operation, and more often if he should deem it to be necessary. The Fire Marshal shall report all failures to comply and conform to any of the provisions and requirements of § 121-4 to the Chief of Police.

If requested by the owner or operator of any such kitchen, room or place so to do, the Fire Marshal, upon any satisfactory inspection, shall issue a certificate of compliance, which shall be prima facie evidence that the fire-extinguishing equipment or apparatus of such kitchen, room, or place conforms to the requirements of § 121-4 at the time of such inspection.
B.Â
No certificate of compliance shall remain in effect
or be entitled to any evidential weight whatsoever after a period
of three months from the date thereof, or, if after its date of issue,
the heating and/or cooking equipment or the fire-extinguishing equipment
or apparatus, or both, of such kitchen, room or place shall be materially
changed or altered, become impaired, or not be in good working order.
