By the authority of the resolution of the Town Board of the
Town of Montgomery, adopted on September 24, 1958, and as that authority
has been amended from time to time and, pursuant to the provisions
of Article 16 of the Town Law of the State of New York, the Planning
Board of the Town of Montgomery is authorized and empowered to approve
plats showing lots, blocks or sites, with or without streets or highways,
to approve the development of entirely or partially undeveloped plats
already filed in the office of the Clerk of the County of Orange within
that part of the Town of Montgomery outside the limits of any incorporated
city or village.
It is declared to be the policy of the Planning Board to consider
land subdivision plats as part of a plan for the orderly, efficient
and economical development of the Town. This means, among other things:
A. That land to be subdivided shall be of such character that it can
be used safely for building purposes without danger to health, or
peril from fire, flood or other menace;
B. That proper provision shall be made for drainage, water supply, sewerage
and other needed improvements;
C. That all proposed lots shall be so laid out and of such size as to
be in harmony with the development pattern and uses of the neighboring
properties;
D. That the proposed streets shall compose a convenient system conforming to the "Official Map" (See definition in Article
II.) if such exists, and shall be properly related to the proposals shown on the Comprehensive or Master Plan and shall be of such width, grade and location as to accommodate the prospective traffic, to facilitate fire protection and to provide access of firefighting equipment to buildings; and
E. That proper provision shall be made for open spaces for parks and
playgrounds.
In order that land subdivisions may be made in accordance with
this policy, these regulations which shall be known as, and which
may be cited as, the "Town of Montgomery Land Subdivision Regulations"
were last adopted by the Planning Board on March 27, 1978, and approved
by the Town Board on April 6, 1978, with amendments in 1989. Based
on revisions to Town Law, these regulations have been adopted by the
Town of Montgomery Town Board as Local Law No. 2 of 2012 on December
13, 2012.
The Town of Montgomery has authorized its Planning Board to
approve plats showing lots, block or sites, with or without streets
or highways or the entire or partial development of plats filed in
the office of the Orange County Clerk or to approve preliminary plats,
as provided in these regulations. The Clerk of the Town of Montgomery
has filed a certificate of that fact with the Clerk of Orange County
on _____ relative to the approval of plats; and on _____ relative
to the approval of preliminary plats.
Reference for subdivision projects in certain circumstances
must be made to the Town of Montgomery Zoning Law. The Town Clerk
of the Town of Montgomery should be contacted regarding the latest
edition of the Zoning Law of the Town.
