The Sewer Inspector and/or Deputy Sewer Inspector
and other duly authorized employees of the Town, NYSDEC and USEPA
bearing proper credentials and identification shall be permitted to
enter all properties for the purpose of inspections, observation,
measurement, sampling and testing pertinent to discharge to the community
system in accordance with the provisions of this chapter. The Town
shall have the right to set up, on the user's property, such devices
as are necessary to conduct sampling or metering operations. The Town
and representatives of NYSDEC and USEPA may, at reasonable times,
have access to and copy any records, inspect any monitoring equipment
or method required by local law entitled "North Greenbush Code Chapter
97, Sewers and Sewage Disposal" and sample any effluent, which the
owner or operator of such source is required to sample. Where a user
has security measures in force, the user shall make necessary arrangements
with its security guards so that, upon presentation of suitable identification,
personnel from the Town, NYSDEC and USEPA will be permitted to enter
without delay.
While performing the necessary work on private properties referred to in §
151-30 above, the Sewer Inspector and/or Deputy Sewer Inspector or duly authorized employees of the Town shall observe all safety rules and care applicable to the premises.
The Sewer Inspector and/or Deputy Sewer Inspector
and other duly authorized employees of the Town of North Greenbush
bearing proper credentials and identification shall be permitted to
enter all private properties through which the Town holds a duly negotiated
easement for the purpose of but not limited to inspection, observation,
measurement, sampling, repair and maintenance of any portion of the
wastewater facilities lying within an easement. All entry and subsequent
work, if any, on said easement shall be done in full accordance with
the terms of the duly negotiated easement pertaining to the private
property involved.
This chapter shall be enforced by the Sewer
Inspector and/or Deputy Sewer Inspector or such other Town officers
as the Town Board shall direct and the Rensselaer County Department
of Health.
The Town may terminate or cause to be terminated
wastewater service to any premises if a violation of any provision
of this chapter is found to exist or if a discharge of wastewater
causes or threatens to cause a condition of contamination or pollution
as defined in this chapter.
