The purpose of this chapter is to establish an agency pursuant to the New York State Uniform Fire Prevention and Building Code to administer and secure compliance with such code.

There is hereby established an agency to be known as the "Owego Housing Standards Agency," with the powers and duties hereinafter set forth.
The personnel of the Agency shall consist of one chief officer who shall be the Mayor unless the Board of Trustees of the Village of Owego shall by resolution designate some other person to fill such office and such other assistants and inspectors as the Board of Trustees may deem necessary and appoint to carry out effectively the powers and duties of the Agency. The term of appointment shall be for the balance of the official year in which the appointment is made. The compensation of the appointees shall be as set forth in the resolution of appointment.

A. 
The powers and duties of the Housing Standards Agency shall be prescribed by the Board of Trustees of the Village of Owego from time to time.[1]

B. 
The chief officer shall have the following powers and duties:
(1) 
Organization and management. He shall be responsible for the organization and internal management of the Agency and may establish and promulgate such rules and regulations necessary to carry out the powers and duties of the Agency.
(2) 
Inspections. He shall make periodic inspections of all premises to which the Uniform Fire Prevention and Building Code applies.[2]

(3) 
Investigations. He shall investigate all complaints of alleged housing violations or other unsafe or unsanitary conditions.
(4) 
Enforcement. He shall enforce the provisions of the Uniform Fire Prevention and Building Code by such means, including legal action, as he deems necessary.[3]

(5) 
Survey and study. He shall survey and study housing conditions within the Village of Owego.
(6) 
Reports. He shall report quarterly to the Board of Trustees of the Village of Owego regarding activities of the Agency and housing conditions within the Village of Owego.
(7) 
Records. He shall maintain records of actions taken by him.
(8) 
Other duties. He shall perform such other duties as may be directed by the Board of Trustees of the Village of Owego.
C. 
The other Agency personnel shall have such of the foregoing powers and duties as may be delegated to them by the chief officer of the Agency.
Agency personnel shall be authorized and have the right, in the performance of their duties, to enter any premises during normal business hours and in an emergency whenever necessary to protect the public interest. Owners, agents and occupants shall be responsible for providing access to all parts of the premises within their control to the authorized Agency personnel acting in the performance of their duties.
All personnel of the Agency shall be free from personal liability for acts done in good faith in the performance of their official duties.
