The Board of Trustees, by resolution, shall determine which sidewalks in the Village shall be designated sidewalks to be retained for public use. The repair, maintenance and general upkeep of designated sidewalks in the berm immediately abutting residential properties shall be the sole responsibility of the Village. The repair, maintenance and general upkeep of designated sidewalks in the berm immediately abutting nonresidential properties shall be the sole responsibility of said property owner(s). Any sidewalks constructed by the Village after the adoption of this chapter shall be designated sidewalks.
A. 
Any sidewalk or sidewalk segment existing in the Village at the adoption of this chapter that has not been determined to be a designated sidewalk shall be classified as an undesignated sidewalk. The repair, maintenance and general upkeep of undesignated sidewalks shall be the sole responsibility of the property owner(s) immediately abutting such sidewalk to the extent that such sidewalk extends along the property.
B. 
Upon written application to the Village, together with an acceptable plan for regrading and planting the berm, any undesignated sidewalk in the Village may be removed by the abutting property owner at his/her sole cost and expense.
C. 
Upon written notice from the Village to the property owner that such abutting undesignated sidewalk is not properly maintained or is in need of repair, the property owner shall remedy such condition. If such condition has not been remedied within 30 days of the date on which the notice was sent, the Village may cause such repair or maintenance to occur, the cost of which shall be borne by the adjacent property owner and, if not paid within 30 days, shall be made a lien against the premises collectible with the next tax levy of the Village.
Responsibility for snow and ice removal on sidewalks shall be as per the general upkeep provisions delineated in this article.
