A.
Pursuant to Article 18 of the Executive Law of the
State of New York, the Town of Tonawanda hereby adopts and accepts
the applicability of the New York State Uniform Fire Prevention and
Building Code. Such code shall be applicable in the Town of Tonawanda,
New York, exclusive of the Village of Kenmore, from and after the
effective date of this chapter.
B.
Unless otherwise provided by law, all other laws,
ordinances, rules and regulations of the United States of America,
the State of New York, the County of Erie and the Town of Tonawanda
shall be applicable in addition thereto.
This chapter provides for the administration
and enforcement of the New York State Uniform Fire Prevention and
Building Code (the Uniform Code) and the State Energy Conservation
Construction Code (the Energy Code) in this Town. This chapter is
adopted pursuant to § 10 of the Municipal Home Rule Law.
Except as otherwise provided in the Uniform Code, other state law,
or other section of this chapter, all buildings, structures, and premises,
regardless of use or occupancy, are subject to the provisions this
chapter.
