This article is intended to promote and improve
the health, safety and general welfare of the community by regulation
of the parking lots of Fire Districts in the Town of Tonawanda, New
York. This article is enacted pursuant to a written request from the
Allied Fire Commissioners of the Town of Tonawanda and is authorized
by § 1660-a of the Vehicle and Traffic Law of the State
of New York.
This article shall only apply to the following parking lots listed in §
140-17 hereof.
It will be the responsibility of the Allied
Fire Commissioners to place and maintain signs in compliance with
the provisions of this article. Signs shall be installed in accordance
with the New York State Traffic Commissioner's Manual of Uniform Traffic
Control Devices.
No person, firm or corporation shall park a
vehicle at any time, whether occupied or not, in the parking lots
at the following locations:
A. Ellwood Fire District No. 1, 1000 Englewood Avenue,
Kenmore, NY 14223.
B. River Road Fire District No. 3, 59 Kaufman Avenue,
Tonawanda, NY 14150.
C. Sheridan Park Fire District No. 4, 738 Sheridan Drive,
Hall No. 1, Tonawanda, NY 14150.
D. Brighton Fire District No. 5, 26 McConkey, Hall No.
2, Kenmore, NY 14223.
E. Kenmore Fire Grounds, 1350 Military Road, Kenmore,
NY 14217.
F. Kenilworth Fire District No. 2, 84 Hawthorn Avenue,
Kenmore, NY 14223.
G. Sheridan Park Fire District No. 4, 1708 Military Road,
Hall No. 2, Kenmore, NY 14217.
H. Brighton Fire District No. 5, 50 Jamaica Road, Hall
No. 1, Tonawanda, NY 14150.
I. Brighton Fire District No. 5, 401 Dexter Terrace,
Hall No. 3, Tonawanda, NY 14150.
This article shall not apply to any person,
firm or corporation attending activities authorized by the Fire District
where located.
This article shall be enforced by the Town of
Tonawanda Police Department, in the manner provided by law, rule or
regulation for the enforcement of traffic or parking ordinances, laws
or rules in the town, including the use of tags, summonses and towing.
Any vehicle towed under the authority of this section will not be
released to its owner until the owner has paid the reasonable cost
of towing and storing of the vehicle.
A violation of this article shall constitute
a traffic infraction within the meaning of § 1800 of the
Vehicle and Traffic Law of the State of New York.
Every person, firm or corporation convicted
of a traffic infraction for a violation of this article shall be punished
by a fine of not more than $50; and for a second or subsequent conviction
within 18 months thereafter, of a fine of not more than $100 for each
violation.
