For the purpose of this chapter, certain words and terms used herein are defined as follows (Note: Except where specifically defined herein, all words and terms shall carry their customary meaning):
APPLICANT
The owner(s) of record or contract vendee who may be represented by an authorized agent.
BUILDING INSPECTOR
The Code Enforcement Officer of the Town of Wawarsing, New York, or duly authorized representative.
BUILDING LOT
Any lot upon which a principal residential or commercial building can be constructed in conformance with the requirements of the Zoning Ordinance.[1]
CONSTRUCTION PLANS
The maps and engineering drawings, described in Appendix A4 of this chapter,[2] accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with this chapter.
DRY HYDRANT
A hydrant installed for fire-fighting purposes which is not connected to a public water supply system and is nonfunctioning at the time of installation.
EASEMENT
Authorization by a property owner for restricted or partial use by another person or body of any designated part of his or her property.
ENGINEER OR LICENSED PROFESSIONAL ENGINEER
A person licensed as a professional engineer by the State of New York.
FRONTAGE
The extent of a building or lot along an approved street, or along a street to be built and dedicated as part of subdivision approval.
HIGHWAY SUPERINTENDENT
The Highway Superintendent of the Town of Wawarsing, New York, or his duly authorized representative.
IMPROVEMENT
Means, but is not limited to, the creation of new streets, building sites, public walkways, parks and recreation areas, water supply and waste disposal facilities.
LOT
A parcel of land not divided by streets.
MAINTENANCE BOND
A bond to assure the maintenance of required subdivision improvements following dedication of such improvements for such period as required by the Planning Board.
OFFICIAL MAP
The map which may be established by the Town Board under § 270 of the Town Law showing the streets, highways, drainage ways and parks theretofore laid out, adopted and established by law, and any amendments thereto adopted by the Town Board, or additions thereto resulting from the approval of subdivision plats by the Planning Board and the subsequent filing of such approved plats.
OFFICIAL SUBMISSION DATE
The date when a subdivision plat, accompanied by all other information required with the application for subdivision approval, is received by the Planning Board at a regularly scheduled Board meeting.
PERFORMANCE BOND
A bond, as required by § 277 of the Town Law, to assure the full and satisfactory completion of all required subdivision improvements as specified in the Planning Board resolution of approval, such bond to run for a term fixed by the Planning Board and with surety, form, sufficiency and manner of execution approved by the Town Board.
PLANNING BOARD
The Planning Board of the Town of Wawarsing, New York.
PLAT or FINAL PLAT
A drawing, in final form, as described in Appendix A3 of this chapter,[3] showing a proposed subdivision and containing all of the information required by these or other applicable regulations and certified by a licensed surveyor or professional engineer.
PRELIMINARY PLAT
The preliminary drawing or drawings, described in Appendix A1 of this chapter,[4] showing the basic features of a proposed subdivision.
RESUBDIVISION
Any change of existing property lines or of property lines shown on a plat approved by the Planning Board and filed in the office of the County Clerk.
SKETCH PLAT
The initial drawings submitted for review to the Town Building Inspector, the Town Engineer, Planning Consultant and the Highway Superintendent, as required, prior to formal submission of a preliminary subdivision plat.
STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQR)
The New York State Environmental Quality Review Act.[5]
STREET
An existing state, County or Town road or highway, a street shown upon a lot approved by the Planning Board, or a street shown on a plat duly filed and recorded in the office of the County Clerk prior to the creation of the Planning Board.
STREET, BUSINESS
A street which serves or is designed to serve primarily as access to abutting business, commercial or industrial properties.
STREET, COLLECTOR
A street which serves or is designed to serve primarily the function of carrying traffic from minor streets to major streets.
STREET, DEAD-END
A street, or a portion of a street, with only one vehicular traffic outlet.
STREET, LOCAL
A street which serves or is designed to serve primarily as access to abutting residential properties.
STREET, MAJOR
A street which serves or is designed to serve primarily as a carrier of through traffic.
STREET, MINIMUM TRAVELED-WAY WIDTH
The entire width of the street pavement portion of a street, measured perpendicular to the center line of such street.
STREET PAVEMENT
The wearing or paved surface portion of the street right-of-way designed to be used by vehicular traffic.
STREET RIGHT-OF-WAY WIDTH
The distance between property lines measured at right angles to the center line of the street.
SUBDIVISION, MAJOR
The division of any parcel of land, regardless of use, into more than three lots, blocks, sites or parcels with or without the creation of new streets, for the purpose, whether immediate or future, of transfer of ownership or building development, and shall include resubdivision as defined herein.
SUBDIVISION, MINOR
The division of any parcel of land, regardless of use, into three or less lots, plots, blocks, sites or parcels, with or without the creation of new streets, for the purpose, whether immediate or future, of transfer of ownership or building development, and shall include resubdivision as defined herein.
TOWN CONSTRUCTION ORDINANCE
The standards and specifications which may be adopted and amended by the Town Board for the construction of streets and related subdivision improvements, and all amendments thereto.
TOWN DEVELOPMENT PLAN
The comprehensive master plan for development of the Town of Wawarsing, New York, prepared by or under the direction of the Planning Board pursuant to § 272-a of the Town Law, and all amendments thereto.
TOWN ENGINEER
Any person employed full-time as the Town Engineer or any consulting engineer retained to act in his place.
TOWN FLOODING, EROSION and SEDIMENT CONTROL LAW
Any local law of the Town of Wawarsing, New York, which may be adopted and as may be amended, providing for the regulation of activities in areas identified as subject to periodic flooding, and regulations to reduce and control erosion and sedimentation.
WETLANDS AND DRAINAGE LAW
Any local law of the Town of Wawarsing, New York, which may be adopted and as may be amended, providing for the protection of wetlands, water bodies and watercourses.
ZONING ORDINANCE
The Zoning Ordinance of the Town of Wawarsing, New York, and all amendments thereto.[6]
