The State Building Conservation and Fire Prevention
Code is hereby declared accepted by and applicable to the Town of
Guilderland in accordance with the provisions of § 392 of
the Executive Law.

A. There is hereby established in the Town of Guilderland
the office of Chief Fire Inspector. The Chief Fire Inspector shall
be appointed by the Town Board and shall serve at the pleasure of
the Town Board.
B. The Chief Fire Inspector is hereby charged with the
duty of administering and enforcing the State Building Conservation
and Fire Prevention Code. For such purpose, he is authorized to enter
any building or premises at all reasonable hours. He shall order the
removal or remedying of all violations and is authorized to issue
and serve or cause to be served all orders, notices, appearance tickets
and other process as may be necessary in the enforcement of such code.
Any person who shall violate any of the provisions of such code or fail to comply therewith or who shall violate or fail to comply with any lawful order made in the administration or enforcement thereof shall be guilty of an offense punishable by a penalty as set forth in Chapter
1, General Provisions, Article
III. The imposition of one penalty for any violation shall not excuse the violation or constitute an authorization for its continuance. The imposition of any penalty hereunder shall not prevent the enforced removal or termination of a prohibited condition.
Except as provided in Section 5 hereof, no other ordinance or local law heretofore enacted shall be deemed abrogated, annulled or repealed by any provision of this article; provided, however, that where this article imposes a greater restriction, its provisions shall control. Any provision of Article
I of this chapter that is at variance, in conflict or inconsistent with any provision of this article shall be deemed superseded by this article.
