The purpose of this article is to protect the public health, welfare,
safety, peace and tranquillity by regulating the operation of motorcycles
within the Town of Guilderland.
This article shall hereafter be known and cited as the "Town of Guilderland
Motorcycle Local Law."
For the purposes of this article, the definition of the word "motorcycle,"
as adopted by § 123 of the Vehicle and Traffic Law, is incorporated
herein.

A. It shall be unlawful for any person to drive or operate
any motorcycle on private lands within the Town of Guilderland within 500
feet of any dwelling or dwelling house between the hours of 11:00 p.m. and
7:00 a.m. except for the purpose of arriving at or departing from said dwelling
or dwelling house.
B. It shall be unlawful for any person to drive or operate
any motor-driven machine on publicly owned lands within the Town of Guilderland
within the area bounded as follows:

On the east and northeast by the corporate limits of the City of Albany;
on the south by Western Turnpike; on the west and northwest by a line commencing
at the intersection of Western Turnpike and Willow Street and running in a
northeasterly direction along the center line of Willow Street to its intersection
with the center line of Siver Road, thence in a northerly direction along
the center line of Siver Road to its intersection with the center line of
Lydius Street, thence northeasterly in a straight line to its intersection
with the corporation line of the Town of Colonie at its nearest point; and
on the north by the corporate limit of the Town of Colonie; except upon public
highways and upon driveways and parking areas appurtenant to publicly owned
facilities.

A failure to comply with the provisions of this article shall be deemed a violation, and the violator shall be subject to a penalty as set forth in Chapter
1, General Provisions, Article

As used in this article, the following terms shall have the meanings
indicated:
The Town Board is hereby empowered to make and promulgate, from time
to time, by order or resolution, such rules and regulations relating to the
use and operation of off-highway motorcycles on off-highway trails and in
off-highway competitions, including the requirement of instruction and training,
as the Town Board may determine in the interest of promoting the public welfare,
convenience and safety. For the purpose of implementing and enforcing such
rules and regulations, the Town Board may impose such restrictions, limitations
and conditions upon the issuance of certificates of registration under this
article as the Town Board may deem appropriate.
The operation of an off-highway motorcycle in violation of this article shall be deemed a violation. Such violator shall be subject to a penalty as set forth in Chapter
1, General Provisions, Article
