A. The purpose of this article is to supersede § 23
of the Town Law and § 3(1) of the Public Officers Law to broaden
the residency requirements for the Town Attorney and Deputy Town Attorney
of the Town of Mamakating so to provide that an attorney who resides in the
counties of Sullivan, Orange and Ulster of the State of New York is eligible
to hold the position of Town Attorney and Deputy Town Attorney.
A. It is determined and ordained by the Town Board of the
Town of Mamakating that it is in the best interest of the residents, taxpayers
and inhabitants of the Town of Mamakating that the existing requirements contained
in Town Law § 23 and Public Officers Law § 3, which require
that the Town Attorney and Deputy Town Attorney of the Town of Mamakating
be a resident of the Town, be dispensed with, and any Town Attorney and Deputy
Town Attorney hereinafter appointed by the Town Board of the Town of Mamakating
need not be a resident of the Town of Mamakating so long as such person resides
in Sullivan, Orange or Ulster County, State of New York.
B. In all other respects, the requirements
of Public Officers Law § 3 are applicable to the foregoing and shall
remain in full force and effect.
