As used in this chapter, the following terms shall have the meanings indicated:
CONSUMER
One who attends the public market to purchase that which is offered for sale.
MARKET POSITION
A space outlined and numbered to which a producer is assigned by the Supervisor.
PRODUCER
One who offers for sale that which he produces on his own farm or premises.
PUBLIC MARKET
A location designated by the Common Council where a producer may offer produce for sale.
SUPERVISOR
One who is appointed to supervise and conduct the public market.
A. 
No person other than a producer shall be entitled to offer any article for sale at the public market.
B. 
The public market will be held on the days and in the locations as designated by the Common Council of the City of Middletown. The Supervisor will cause to be displayed in the local newspaper, the day or days and the hours and locations of the public market.
C. 
The hours of the public market shall be during the summer months on Tuesdays and Thursdays from 5:30 p.m. to 8:00 p.m., and on Saturdays from 6:00 a.m. to 9:00 a.m., unless the Supervisor shall deem it advisable to advance the opening hour. Due notice of any change shall be given in the local newspaper.

D. 
Market positions will be assigned each producer by the Supervisor, and these locations, when assigned, shall be occupied by the producer throughout the market season unless changed for the following reasons:
(1) 
Failure to occupy the position within one hour after the official opening of the market, in which event the location may be assigned on that day to another producer.
(2) 
Failure of the producer to occupy his designated location at least once per week during a three weeks' period, in which event the Supervisor may assign the location to another producer.
E. 
Each producer shall pay a fee of $0.50 per diem.

F. 
All produce shall be displayed in conformity with the rules of the Board of Health of the City of Middletown.
G. 
Only the following articles may be offered for sale: Vegetables, fruits, live poultry, honey, butter, eggs, cheese, cider, vinegar and cut flowers.
H. 
Each producer shall establish the price of the article which he offers for sale.
Any person violating any of the provisions of this chapter shall, upon conviction, be punished by a fine not exceeding $10, and, if such person be a producer, shall, in addition, forfeit his market position and shall be suspended from offering any articles for sale at such public market for a period of three marketing days.
