It is the purpose of this chapter to protect, ensure and promote the
health, safety and well-being of the public on the public beach area located
within and/or contiguous to the Incorporated Village of Sylvan Beach through
the implementation of regulations for the use of said public beach. These
uses shall not be construed as permission to violate or interfere with the
rights of others to use the public beach area for sunbathing, walking or other
legalized uses.
The following definitions shall apply to this chapter of the Sylvan
Beach Code:
BUILDING
Any temporary or permanent structure having a roof supported by posts,
columns or walls and intended for the storage, shelter, housing or enclosure
of any individual, animal or object.
CONTESTS
Includes beauty contests, swimsuit contests, sand-castle-building
contests and similar contests.
ORGANIZED ACTIVITIES
Those activities sponsored by a person, company, corporation or other
entity for the purpose of promotion, business or profit and include, but are
not limited to, sports, games, contests and parties.
PUBLIC BEACH AREA
Any sandy areas adjacent to Oneida Lake located either within or
contiguous to the Village of Sylvan Beach. Public access rights-of-way adjacent
and contiguous to the public beach are also included in the public beach area.
STRUCTURE
Anything temporarily or permanently built, constructed, erected,
or placed on the ground, including any obstruction, the intended use of which
requires location on the ground or attachment to something having location
on the ground, including, but not limited to, hang gliders, wind surfers,
canoes, boats, personal watercraft, boat lifts, docks, tents, rafts, picnic
tables, and the like.
UPLAND PROPERTY
Parcels located adjacent to any stretch of the public beach area.
No person, partnership or corporation shall, at any time, drive, operate,
park or cause to be driven, operated or parked a motor vehicle or motorcycle
as defined in the Vehicle and Traffic Law of the State of New York, or any
other type of motor vehicle, such as, but not limited to, a motorbike, all-terrain
vehicle, etc., upon any public beach area except emergency vehicles and such
other vehicles as authorized by the Village of Sylvan Beach.
No person, partnership or corporation shall permit, at any time, any
animals upon any public beach area.
No person, partnership or corporation shall, at any time, drive or operate
a boat or any other watercraft within 1,500 feet of a shoreline or public
beach area within the jurisdiction of the Village of Sylvan Beach in such
a manner as to cause or create a disturbance or cause alarm or fear for the
safety of persons or property.
No person, partnership or corporation shall, at any time, start or maintain
a fire of any kind on the public beach area of the Village of Sylvan Beach.
It shall be unlawful for any person, company, corporation or other entity
to temporarily or permanently build, place or construct or cause to be built,
placed, or constructed any building or structure on the public beach area.
No person, partnership or corporation shall deposit or pile leaves,
brush, concrete, construction debris, logs, rubbish, refuse, seaweed or other
aquatic plant materials on the public beach area. Nothing herein precludes
an upland owner or guests from removing such objects from the public beach
area in front of his or her upland property.
Glass and glass containers are prohibited on the public beach area.
Alcohol and alcoholic beverages are prohibited on the public beach area.
The Village Board, by resolution, may require permits for organized
or unorganized activities in the public beach area. Rules, fees, etc., may
be established by Board resolution.
Any person, company, corporation or other entity that violates this
chapter or fails to comply with any of its requirements shall, upon conviction
thereof, be fined no more than $250 for each violation and shall be required
to immediately come into compliance with this chapter. Each day any such violation
shall continue shall constitute a separate offense.
