The use of the Town streets or public places
for television, motion picture or still photography production is
permitted and encouraged subject to the limitations and requirements
of this chapter.
Anyone wanting to conduct such activities must
apply for and procure from the Town a permit for the use of Town streets
and/or public places for television, motion picture or still photography
purposes. The permit is to be issued by such officer or office of
the Town as shall be designated from time to time by resolution, the
Building Department being so designated, subject to change by resolution.
A form of application for a permit shall be
prepared by the Building Department or such agent as is designated
by the Town Board.
At a minimum, the application must include the
full name and address of the applicant, the locations and times during
which it is intended to conduct the activities sought, the nature
of the activities, the equipment, the number of persons intended to
be involved in the production and the insurance companies which insure
the activities of the applicant. The applicant shall submit such additional
information and documentation as shall be required in the permit application
from time to time.
A fee shall be paid by the applicant at the
time of the submission of the application. A separate fee may be fixed
for the permit itself and a location fee in connection with a specific
activity on public property. The amount of the fee shall be fixed
by resolution of the Town Board from time to time.
If the permit involves an activity on the Town
roads or a Town public place, liability insurance, naming the Town
as an additional insured, shall be procured and presented prior to
the effectiveness of any permit sought. Such liability insurance shall
insure against injury to person or property and shall be in an amount
not less than $100,000. The required insurance limits may be increased
by resolution of the Town Board.
The Town may inquire as to provisions to be
made by the applicant for security, traffic diversion and such other
precautions as may be required and requested to assure that the issuance
of the permit will not be dangerous or detrimental to public health,
safety or the general welfare of the community. The applicant must
sufficiently demonstrate such precautions so that the Town will issue
the permit. The permit officer designated by the Town shall have the
discretion to deny a permit if the public health, safety or general
welfare of the Town is endangered.
Hours for filming and general activities pursuant
to the permit shall be between 6:00 a.m. and 8:00 p.m. at public locations.
Waivers may be granted in special circumstances, provided that proper
precautions are adopted.
