The Town Clerk of the Town of Warwick may issue a permit for conducting of games of chance within the corporate limits of the Village of Warwick, as authorized by the Constitution of the State of New York and by § 187 of the General Municipal Law. Such permit shall be issued only in accordance with state law and subject to the same conditions or limitations imposed upon the conduct of games of chance in the unincorporated area of the Town, except that enforcement thereof shall be by Village police officials.
This chapter shall remain in effect until superseded or repealed as provided in state law, and the Town Clerk shall have the authority granted by this chapter only so long as the Clerk has the authority to issue permits in the unincorporated area of the Town of Warwick.
This chapter is subject to a permissive referendum and shall be submitted to a vote of the residents of the Village of Warwick on motion of the Board of Trustees on July 5, 1979. Following approval of such chapter, such chapter shall take effect upon filing in the office of the Secretary of State.[1]
