No owner or occupant of any dwelling house, store or other building
shall fix, put up or erect, or suffer to remain fixed, put up or erected,
except by permission of the Board of Trustees granted by resolution at a regular
meeting, any permanent awning or shed upon or over any street or sidewalk,
or any signpost, sign or fixtures, projecting into or over any street or sidewalk
more than three feet six inches or which shall be less than eight feet six
inches above the sidewalk.
Awnings made of cloth may be erected and used in any street if made
and supported in the manner following and not otherwise:
A. The shall not extend further than the outer edge of the
sidewalk.
B. They must be supported by iron frames, which shall be,
at their lower side, not less than eight feet from the sidewalk, and no part
of such awning shall be at a distance less than seven feet from the sidewalk.
No person shall hang or place any goods, merchandise or other articles
upon any awning or frame over a sidewalk.
Any person committing an offense against any provision of this Article
shall be guilty of a violation punishable by a fine not exceeding $250 or
by imprisonment for a term not exceeding 15 days, or by both such fine and
imprisonment. The continuation of an offense against the provisions of this
Article shall constitute, for each day the offense is continued, a separate
and distinct offense hereunder.
