For the purpose of this chapter, certain terms and words shall be interpreted to have the following meanings: words used in the present tense include the future; the plural includes the singular; the word "shall" is intended to be mandatory; "occupied" includes the words designed, intended or arranged for occupancy; and the word "person" may include more than one, an association, a copartnership or a corporation. Words not defined herein shall be given the meaning that is provided under §
185-13, Definitions, of Chapter
185, Zoning. If any term is defined herein, that definition shall control. Words not defined herein, or not defined in Chapter
185, shall be accorded their usual and customary meaning.
As used in this chapter, the following terms
shall have the meanings indicated:
DOUBLE-WIDE
A factory-manufactured home transportable in two sections,
eight body feet or more in width or 40 body feet more in length, each
containing 400 or more square feet of interior space when erected
on site with each of the two sections intended to be joined during
final assembly on-site.
FACTORY-MANUFACTURED HOME OR MODULAR HOME
A structure or components thereof designed for residential
occupancy, constructed by a method or system of construction whereby
the structure or component is wholly or in substantial part manufactured
in a manufacturing facility and is intended for permanent installation
on a building site. A factory-manufactured home or modular home or
component thereof is transported to the building site upon a steel
chassis which is totally removed at the site, and the wood-framed
structure placed upon a permanent foundation. Every factory-manufactured
home or modular home or component shall bear an insignia of approval
issued by the State Fire Prevention and Building Code Counsel (from
Official Compilation, Codes, Rules and Regulations of the State of
New York, Part 1200, Subchapter D, Article 2, Factory-Manufactured
Homes, Parts 1210 and 1212).
FLOOR SPACE
For the purpose of determining the minimum floor space, or
square footage requirement for principal building, the square footage
shall be determined by multiplying the width (measured in feet from
exterior wall to exterior wall) by the length (measured in feet from
exterior wall to exterior wall), excluding any add-ons not part of
the original manufactured structure.
MOBILE HOME
A transportable structure built on a permanent chassis, meaning
the steel under-structure remains with the unit when placed on a site,
with or without the wheels utilized in transportation, the permanent
chassis being a design feature allowing for the future removal of
the unit(s) from a site without the necessity of utilizing a new under-structure.
The removal of the wheels or the anchoring of a mobile home to a permanent
foundation shall not remove it from this definition. A mobile home
is designed to be used as a dwelling, with or without a permanent
foundation, when connected to required utilities and includes the
plumbing, heating, air-conditioning and electrical systems contained
therein. Every mobile home shall have a manufacturer's label which
certifies that, to the best of their knowledge and belief, the home
is in compliance with all applicable federal construction and safety
standards. Every mobile home shall bear a data plate, affixed in the
manufacturing facility, bearing not less than the following information:
the statement, "This mobile home is designed to comply with the federal
mobile home construction and safety standards in force at the time
of manufacture" and reference to the structural zone and wind zone
for which the home is designed.
MOBILE HOME PARK
Any parcel of land upon which two or more mobile homes are
placed.
OCCUPANCY
The use of a structure, building, mobile home, modular home
or trailer by persons for cooking, living and sleeping purposes.
TRAVEL TRAILER
Any self-propelled vehicle used or capable of being used
for camping, temporary dwelling or shelter while sleeping, including
travel or utility trailer or camper (including truck-carried camper)
which is designed to be self-propelled, towed or carried on another
vehicle. These vehicles are customarily only used seasonally.
