The construction and reconstruction of streets in the Borough of Kutztown shall be done in conformity with the specifications, regulations and provisions set forth in this article.
As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Kutztown.
BOROUGH COUNCIL
The Council of the Borough of Kutztown.
BOROUGH MANAGER
The corporate official appointed by the Borough Council as the Borough Manager or such official's properly designated representative.[1]
BOROUGH SECRETARY
The corporate official appointed by the Borough Council as the Borough Secretary or such official's properly designated representative.[2]
ENGINEER
The Engineer of the Borough of Kutztown appointed by Borough Council.
STREET[3]
A public or private right-of-way, excluding driveways, intended for use as a means of vehicular and pedestrian circulation which provides a means of access to abutting property. The word "street" includes thoroughfare, avenue, boulevard, court, drive, expressway, highway, alley, lane and road or similar terms. "Street" shall include all the land within the street right-of-way lines, whether improved or not. Streets shall be classified as follows:
A. 
ARTERIAL STREETA street serving a large volume of comparatively high-speed and long-distance traffic. At the date of adoption of this article, "arterial streets" within the Borough were West Main Street, East Main Street, Greenwich Street, Noble Street and Willow Street.
B. 
COLLECTOR STREETA street which intercepts minor streets to provide a route to give access to community facilities and/or other collector and arterial streets. Generally, streets in industrial and commercial subdivisions shall be considered "collector streets." At the date of adoption of this article, "collector streets" within the Borough were Normal Avenue, Constitution Boulevard, North Constitution Boulevard, West Walnut Street, College Boulevard, Wentz Street and North Elm Street.
SUPERINTENDENT
The Superintendent appointed by the Borough Council or its duly authorized representative.

All work done pursuant to the provisions of this article shall be inspected by the Borough Manager or his duly authorized representative.

All components of new streets or reconstructed streets in the borough shall be in accordance with the guidelines and requirements for design of local road and streets contained in Design Manual, Part II, Highway Design and PennDOT Publication 408/2003 Edition, or latest edition and revisions, and shall meet the following minimum required standards for materials and construction methodology:
A. 
Subgrade: all classes. All new streets or reconstructed streets in the borough shall be constructed on a properly prepared subgrade in accordance with Section 210, Subgrade, Publication 408/2003 PennDOT specifications, latest revision. Pavement base drain may be required based on subgrade conditions. Pavement base drain shall be installed in accordance with Section 610, Pipe Underdrain and Pavement Base Drain, PennDOT Publication 408/2003, latest revision.
B. 
Geotextiles: all classes. Geotextiles used in conjunction with construction of new streets and reconstructed streets shall conform to Section 212, Geotextiles, PennDOT Specifications, Publication 408/2003, latest revision.
C. 
Subbase: all classes. The base course component of all new streets and reconstructed streets within the Borough of Kutztown shall be placed upon a 2A aggregate subbase meeting the requirements of Section 350, Subbase, PennDOT Specifications, Publication 408/2003, latest revision, and § 192-7(H) of this chapter.
D. 
Bituminous concrete base course: all classes. A bituminous concrete base course shall be utilized for all new streets and reconstructed streets in the borough in accordance with Sections 305, 309, 320 and 321, Bituminous Concrete Base Course, PennDOT Specifications, Publication 408/2003, latest revision, and § 192-7H of this chapter. Superpave asphalt mixture design, 25.0 mm, PG64-22 base course shall be used. The design mix shall be submitted to the borough for review, including the anticipated load requirements and appropriate ESAL.
E. 
Bituminous wearing course. The bituminous surface course shall be utilized for all new streets and reconstructed streets in the borough in accordance with Sections 409 and 420 per PennDOT Specifications Publication 408/2003, latest revision, and § 192-7H of this chapter. ID-2 or superpave asphalt mixture design, 9.5 mm, PG64-22 wearing course shall be used. The design mix shall be submitted to the borough for review, including the anticipated load requirements, appropriate ESAL and skid resistance level.
F. 
Sealer. When the wearing course is placed adjacent to concrete or utilities within the paved portion of the street before the surface has cooled, it shall be sealed with hot bituminous material, PG64-22 or rubberized asphalt material, for a distance of 12 inches from the concrete or utility within the street area. The sealing material shall be evenly applied to the surface by means of squeegees or other devices to provide placement of material in a neat line immediately after placement of wearing course to completely fill the surface voids and provide a watertight joint along the concrete.
G. 
General requirements.
(1) 
All materials, methods of construction and equipment shall be in accordance with PennDOT Specifications, Publication 408/2003, latest revision.
(2) 
In the application of asphalt or other liquid materials, care must be taken so that the same will not be applied excessively or carelessly to the curbs, and in the event of the same, it shall be removed by the applying party.
(3) 
Concrete curb or driveways chipped, broken or damaged during roadway construction shall be properly repaired and/or replaced by the person or persons responsible for the same.
H. 
Pavement Design Guidelines. The following are Pavement Design Guidelines for use in the construction of streets in the Borough.

NOTES:

AADT means average daily traffic.

Where 2-1/2 inches or greater of surface course is indicated, 1 inch shall be ID-2 or superpave asphalt mixture design wearing course and the remainder ID-2 or Superpave Asphalt mixture design binder course. Where 1 1/2” depth of surface course is indicated, the entire 1 1/2 inches shall be ID-2 Superpave Asphalt mixture design wearing course.

For rigid pavements, the contraction joints shall be sawed at a skew of 2 feet for every 12 feet of width at a spacing of 15 feet for all plain cement concrete slabs. Expansion joints shall be provided at intersections where the adjoining pavement is concrete. The Borough shall review scoring patterns prior to construction.
4.
Bituminous concrete base course or plain cement concrete pavements are recommended for all street construction in the Borough. The acceptability of the other alternatives listed above shall be determined by the Borough after written request by the contractor.
4.
Cross slope for roadways shall be 1/4 inch per foot. The acceptability of other alternative cross slopes shall be determined by the Borough after written request by the contractor.

The Borough of Kutztown will accept into the Borough street system only those streets within or adjacent to subdivisions or land developments which have been constructed in accordance with the specifications and requirements of this article and Chapter 195, Subdivision and Land Development, of the Borough. Proof of compliance with the specifications and requirements of § 192-7 of this article shall be provided by written request of the person, firm, partnership, corporation, association, trust or other entity offering the street for dedication to have the engineer perform a field investigation of construction completed. The cost of such field investigation shall be borne by the person, firm or corporation offering the street for dedication.

The Borough may hereafter take into its street system any street constructed in accordance with this article upon receipt of a petition containing a general release in favor of the Borough, duly executed by all of the abutting property owners, requesting the Borough to accept such street into the Borough street system, provided that all other conditions imposed by the Borough Code concerning the taking over of said streets are complied with, and provided that curb has been installed on both sides of the street in accordance with the requirements of Ordinance No. 14-1972 of the Borough of Kutztown, as from time to time amended and supplemented.[1]

Any person or persons violating any of the provisions of this article shall, upon conviction thereof, be fined a sum not in excess of $300 for each and every offense, or, in default of the payment of fine and costs, such person or persons shall be committed to the Berks County Jail for a period not exceeding 30 days.
