"Disorderly conduct" within the meaning of this chapter shall be and
is hereby defined as any act, word or conduct causing or tending to cause
a disturbance of the peace and good order of the Township or which causes
or has a tendency to cause any discomfort, annoyance or danger to the safety
of persons or property within the Township, including, but not limited to:
vandalism; fighting; drunkenness; loafing; vagrancy; begging; indecent acts;
use of profanity or indecent language; the making or causing to be made of
noises, clamor, din or other sounds disturbing or tending to disturb the peace
and quiet of the community; the carrying on of any business, trade, transportation,
recreation or amusement causing or tending to cause noise, disturbance or
danger; and the driving or operation or other use of vehicles by owners, occupants
or users thereof which shall endanger the safety or interfere with the comfort
and convenience of persons traveling or residing in the Township. All such
acts, words or conduct are hereby prohibited.
Any and all noises or other sounds, which, even though they are customary
and unavoidable as attendant upon the ordinary operation or performance of
a trade, business, transportation, recreation or amusement, if made during
hours other than the usual and customary hours for such work or activity,
are and shall be considered to constitute disorderly conduct and a disturbance
of the peace and are hereby prohibited.
Without in any manner intending to limit or restrict the definitions and prohibitions of §§ 69-1 and 69-2 hereof, the following particular acts are hereby declared to constitute disorderly conduct and disturbing the peace and are hereby prohibited:
A.
The unnecessary sounding of automobile horns, sirens,
bells, whistles or other warning devices or the operation or use of any motor
vehicle which results in unnecessary or unusual noise caused by improper muffler,
backfire or racing of such motor vehicles or racing of the motor; the operator
of a motor vehicle shall at all times exercise due care and foresight and
maintain proper control of his vehicle and shall not substitute the soundings
of warnings for careful driving;
B.
The keeping or handling of dogs or other animals under
such conditions or lack of control, or in such a manner that they disturb
the peace and quiet or endanger the safety of the immediate neighborhood;
C.
Acting in and about the roads, streets, highways or other
public places of the Township in a noisy, loud, boisterous, unseemly, indecent,
or obscene manner or in such manner as to disturb the peace and quiet of the
community;
D.
Loafing, loitering or congregating on the street corners
or in or about any place of business or any other public place in the Township.
Except in cases of emergency, any person violating any of the provisions
of this chapter shall, upon conviction in a summary proceeding brought before
a District Justice under the Pennsylvania Rules of Criminal Procedure, be
guilty of a summary offense and shall be punishable by a fine of not more
than $1,000, plus costs of prosecution. In default of payment thereof, the
defendant may be sentenced to imprisonment for a term not exceeding 30 days.
Each day or portion thereof that such violation continues or is permitted
to continue shall constitute a separate offense, and each section of this
chapter that is violated shall also constitute a separate offense.
