It shall be unlawful to throw, deposit or dump any paper, trash, rubbish,
ashes, junk, waste, garbage, or discarded materials of any kind in or on any
private or public property, vacant or occupied, within the Township of Lower
Frederick, or to maintain any accumulations of such materials in or on any
public or private property, vacant or occupied, within said Township.
It shall be unlawful to store or deposit any abandoned or junked automobiles
or parts thereof in or on any public or private property, vacant or occupied,
within the Township of Lower Frederick.
It shall be unlawful to carry on or maintain any offensive manufacture
or business anywhere within the Township of Lower Frederick.
It shall be unlawful to use, maintain, occupy or own any unsafe or dangerous
building, structure or physical condition, or any part thereof, anywhere within
the Township of Lower Frederick.
The violation of any of the foregoing shall be deemed to be and constitute
a nuisance. Whenever it is found that any person, partnership, association,
or corporation maintains such nuisance within the Township of Lower Frederick,
the said Supervisors of said Township shall serve notice to that effect upon
the person, partnership, association or corporation maintaining such nuisance.
Such notice shall sufficiently describe the condition complained of and shall
require the same to be made safe, to be corrected or to be removed.
Should such person, partnership, association, or corporation fail, neglect,
or refuse to make such condition safe or to correct or remove it to the satisfaction
of said Supervisors of the Township of Lower Frederick, they, the said Supervisors,
may abate or cause to be abated said nuisance, and the expense of such abatement
shall be paid by such person, partnership, association or corporation, and
the cost of such abatement or correction or removal of such nuisance, together
with a penalty of $10, shall be recovered from such person, partnership, association
or corporation by the said Supervisors of the Township of Lower Frederick,
by summary proceedings to be brought before a District Justice in said Township.
Any person who shall violate any of the provisions of this chapter or
who shall fail to comply with any notice from the Supervisors aforesaid shall,
upon being found liable therefor in a civil enforcement proceeding commenced
by the Township before a District Justice, pay a fine of not more than $600,
plus all court costs, including reasonable attorney's fees, incurred by the
Township in the enforcement of this chapter. No judgment shall be imposed
until the date of the determination of the violation by the District Justice.
If the defendant neither pays nor timely appeals the judgment, the Township
may enforce the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the Township are hereby authorized to
seek equitable relief, including injunction, to enforce compliance herewith.
