All spray irrigation and stream discharge type
sewage disposal systems hereafter installed within the Township of
Lower Frederick, Montgomery County, Pennsylvania, shall conform to
the following rules and regulations, which shall govern their design,
installation, maintenance and removal, in addition to those regulations
now in effect, and hereafter adopted by the following agencies:
A. Pennsylvania Department of Environmental Protection;
B. Pennsylvania Soil Conservation Service;
C. Montgomery County Board of Health; and
D. All other federal, state and governmental agencies
having jurisdiction over such installations.
Prior to the installation of any spray irrigation
or stream discharge system within Lower Frederick Township, a permit
from the Township shall be required for such installation. This permit
shall be in addition to all permits required from the DEP, EPA or
the Board of Health, if any.
The following information shall be submitted
to Lower Frederick Township so that a "determination of eligibility"
may take place:
A. Completed 537 revision form;
D. Reviewed by licensed engineer.
An application fee as set from time to time by resolution of the Board of Supervisors shall be submitted along with the information required in §
123-40. No review may begin until such time that this fee has been paid.
No permit shall be issued by Lower Frederick
Township until such time the following requirements have been met:
B. Written agreement approved by Board of Supervisors
and executed by both parties;
D. Permit from Montgomery County Board of Health and
DEP forwarded to Lower Frederick Township.
All removal and/or disposal of the system shall
be in compliance with the written agreement, and shall require notice
to the Lower Frederick Township Administrative Office no less than
15 days prior to the start of removal or disposal.
Permits are nontransferable. The owner/permittee
of each spray irrigation and stream discharge system shall agree to
maintain and be responsible for the system subject to the terms and
conditions stated in the previous sections, until such time a new
agreement and escrow has been established between the next property
owner and Lower Frederick Township.
The Board of Supervisors of Lower Frederick
Township reserves the right to amend these regulations from time to
time as deemed necessary.
