This article establishes a code regulating the manner in which garbage, refuse and rubbish shall be stored, collected and disposed; declaring and defining certain conditions as nuisances; fixing the responsibilities and duties of persons storing, collecting and/or disposing of garbage, refuse and rubbish; providing for issuance of permits to collect garbage, refuse and rubbish; and providing penalties for violation thereof.
The owner, agent, lessee, tenant and/or occupant of every dwelling, food establishment or public place or other premises in the Borough where garbage, refuse, rubbish and ashes may accumulate shall provide and keep on the premises sufficient and suitable receptacles with tight-fitting covers for receiving and holding garbage, decaying refuse and rubbish and other waste of any kind. The capacity of such receptacles shall be not less than that required to contain all of the normal accumulation of such wastes from such dwellings or establishments between regular collection periods.
A. 
"Sufficient" is defined, for the purpose of this section, to be at least one receptacle for each family unit or other occupant of premises, and at least two such receptacles for each restaurant, market, store or similar business establishment where the aforesaid refuse shall accumulate.
B. 
"Suitable" is defined, for the purpose of this section, to be a watertight metal or plastic receptacle with a tight-fitting cover so constructed as to prevent leakage or spilling of its contents. Each receptacle for use at a single residence shall have a capacity of not more than 32 gallons and be equipped with a pull handle or handles.
C. 
Receptacles for refuse from multidwelling units or industrial premises may have a greater capacity than that prescribed in Subsection B hereof, provided they are:
(1) 
Watertight.
(2) 
Constructed of metal or plastic.
(3) 
Equipped for handling by motorized equipment.
(4) 
Cleaned and sanitized as needed after emptying.
(5) 
Replaced by the same type of receptacle if removed for emptying.
A. 
Each and every receptacle in which garbage or other offensive or decaying refuse or matter that shall be kept at any time shall constantly be maintained by the persons having charge thereof in a reasonably clean and inoffensive condition. No such receptacle shall be filled to a point higher than its sides at any time. All such receptacles shall be watertight and shall be securely covered at all times so that the contents thereof will be inaccessible to animals, fowl or flies. Receptacles that are broken or otherwise fail to meet the requirements of this section may be classed as refuse and collected and disposed of as such by the person or agency responsible for the collection of refuse.
B. 
Receptacles of refuse shall not be set out for collection except during hours of the day or days scheduled for collection of refuse, or the evening before, and returned to its original storage location no later than one evening after collection.
C. 
Receptacles shall be conveniently located on premises for storage of refuse and maintained in such manner as to prevent creation of a nuisance or menace to public health.
A. 
Garbage shall be thoroughly and completely drained of all liquids and placed in a receptacle as described above.
B. 
Combustible waste shall not be mixed with other refuse when prepared for disposal by incineration.
C. 
Recyclable materials shall be handled in accordance with the requirements of Chapter 213, Recycling, of the Code of the Borough of New Providence, and as amended from time to time, which is included herein by reference.
A. 
Residential dwellings. Garbage and decaying refuse must be removed from the premises of every family dwelling and apartment complex as frequently as is determined by the Borough of New Providence solid waste collection contract to avoid constituting a menace to community health, safety and well-being.
B. 
Business establishments. The owner, agent, lessee, tenant or occupant of any premises whereon a business or industry is conducted shall arrange for the removal of refuse from such business or industry, of every food establishment and public place or any other business on a scheduled basis. The schedule should be established to avoid constituting a menace to community health, safety and well-being.
C. 
Refuse shall be disposed of only through use of sanitary landfills established, conducted, operated and maintained in accordance with standards established by the New Jersey State Department of Health and code or regulations of the New Jersey Air Pollution Control Commission or other methods of disposal as may be permitted by code or regulation of that Commission.
No garbage, refuse or rubbish or any other waste of any kind whatsoever shall be dumped or deposited upon any public or private property or thoroughfare within the limits of the Borough or used as fill of any kind. Garbage shall not be burned in any manner in any open fire or outdoor incinerator. No person shall place, dump or deposit or permit or suffer to be placed, dumped or deposited or to remain upon any lot or place within the limits of the Borough any garbage, refuse or rubbish.
All owners, lessees, agents, tenants and occupants of any lot, land or parking facilities in this Borough shall keep the sidewalks, gutters and streets in front of such lots and lands free from filth, slop, dirty water, rubbish and all other things dangerous to community health and safety.
No person shall bring into, store or keep rags, bones, scraps or refuse matter within the limits of the Borough except by permission of the Board of Health which, in granting such permit, reserves the right of revocation at any time.
Compost heaps shall be properly maintained as prescribed in the DEP's Leaf Composting Manual For New Jersey Municipalities. Copies are on file in the Board of Health and Municipal Clerk's office.
Vehicles used for the purpose of collecting refuse from receptacles as prescribed by the provisions of this chapter shall be loaded in such fashion that no part of the contents shall fall, leak or spill therefrom. Each such vehicle shall be adequately and tightly covered as may be directed by the Board of Health.
The storage, collection or disposal of refuse in violation of any provision of this chapter is hereby declared to be a nuisance and detrimental to public health.

No person shall throw into or deposit in any toilet or other receptacle connected with the sewer system of the Borough any offal, meat, fish, garbage, ashes or other substances except those for which any such place is the appropriate depository or receptacle.
