No person or persons, firm or corporation shall have or keep in his, their or its possession any live chickens, pigeons or other fowl nor have or keep in his, their or its possession any animal or animals for the purpose of breeding nor permit the breeding or raising of animals on any property which such person or persons, firm or corporation shall own or otherwise control without first having obtained a license or permit for that purpose from the Board of Health[1] of said Borough.

Applications for such permit or license shall be in writing, signed by the applicant, if an individual, and, if the applicant is a corporation, by a thereunto duly authorized officer of such corporation, and shall be filed with the Health Officer of said Borough and shall be accompanied by a filing and inspection fee in the amount provided for in Chapter 134, Fees, Board of Health.
Upon the filing of an application for a permit or license for the keeping of live chickens pursuant to this section of this chapter, the Health Officer of the Borough shall investigate the same to determine whether the applicant has complied with the following rules and regulations:
A. 
The house or coop for the keeping of said chickens shall be located at least three feet from the rear and side property lines and shall be at least 100 feet from the nearest dwelling house other than the dwelling house of the applicant.
B. 
The house or coop for the keeping of said chickens shall be constructed with plans and specifications issued by the New Jersey Agricultural Experiment Station and on file with the Building Inspector of the Borough as a guide. Plans and specifications for such house or coop shall be first approved by said Building Inspector. The interior of such house or coop shall provide at least four square feet of area for each adult chicken.
C. 
The said house or coop shall be kept and maintained in a sanitary manner.
D. 
All live chickens shall be confined to the said house or coop, and no chicken run of any kind shall be permitted. A wire porch attached to said house or coop may be permitted, which porch shall consist of one-inch mesh hardware cloth for the floor, which floor shall be on the same level as the floor of the house or coop, with any convenient-size wire for the sides and top, extending not more than four feet in front of the house or coop.
E. 
No more than 20 chickens shall be kept by any one applicant at any one location. No crowing roosters shall be kept.
Applications for a permit or license under the provisions of this chapter, following investigation by the Health Officer, shall be referred to the Board of Health for action thereon.
A license or permit for the keeping of live chickens upon an application under this chapter or for the keeping of pigeons or other fowl or for the keeping of animals for the purpose of breeding, if granted by the Board of Health, shall continue in force and effect until the first day of March next ensuing the date of the granting thereof, unless previously revoked by the Board upon reasonable notice to the holder of the permit and a reasonable opportunity to be heard by the Board on the question of such revocation.

Any person or persons, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine not less than $2 nor more than $500. Each day that such violation shall continue shall be deemed a further and separate offense under the terms of this chapter, subject to the penalties herein prescribed.
