The following definition shall apply to this chapter:
DEALER IN PRECIOUS METALS AND GEMS
A person in the business of purchasing, offering to purchase, swapping, offering to swap, accepting for consignment, selling, offering to sell, hypothecating or otherwise dealing in or trading used or secondhand gold, silver or other precious metals, used or secondhand precious gems and jewelry including, but not limited to, articles made therefrom, coins, with or without numismatic value, used jewelry of all descriptions, sterling silver, silver plate, semiprecious gems or watches, other than as a consumer buying the same in a normal commercial manner or as an incidental seller of such items so acquired.
No dealers in precious metals and gems shall engage in such business until a license to do so has been obtained from the Chief of Police.
A. 
The license application shall be on a form approved by the Chief of Police and shall contain at least the following information:
(1) 
The name and address of the person, firm or corporation conducting said business;
(2) 
If a corporation, the names and addresses of all officers and stockholders of said corporation; and
(3) 
The location at which said business will be conducted and the hours of operation.
B. 
The applicant shall pay a license fee to the Borough Clerk in the amount of $100.

Every dealer in precious metals and gems shall maintain a legible and complete record of each item purchased or received by the dealer including the date and time acquired, a description of the article including weight and any inscriptions, and the price paid therefor, together with the name, residence address, occupation, date of birth, social security number, and telephone number of the person from whom the dealer received the item. The records shall be on forms approved by the Borough Police Department and shall be available for inspection by the Borough Police Department at all times.
Every dealer in precious metals and gems shall deliver to the Chief of Police the description of all items purchased or sold, within 48 hours of the completion of the transaction on forms prescribed by the Chief of Police.
No dealer in precious metals and gems shall sell, melt, change the form of, remove from the premises or otherwise dispose of any article bought or received by the dealer in the borough within seven business days. Any dealer wishing to store his merchandise other than on the premises where he is engaged in business may make application to the Chief of Police for permission to remove the same from the dealer's premises to the alternate designated location; provided, however, that said location is in the borough.
A. 
It shall be a violation of this chapter to transact any business to which the chapter refers without first having obtained the license as herein required or to fail to adhere to the recordkeeping and reporting requirements hereof. It shall be a separate and distinct violation of this chapter for each article and each transaction which shall be omitted from the required reports.
B. 
The initial offense under this chapter shall be punishable by imprisonment for a term of not more than 180 days or a fine of not less than $100 nor more than $500, or both. Any subsequent offense, shall, in addition to the foregoing penalties, result in the revocation of the dealer's permit by the Mayor and Council.
