The following definition shall apply to this chapter:
DEALER IN PRECIOUS METALS AND GEMS
A person in the business of purchasing, offering to purchase, swapping,
offering to swap, accepting for consignment, selling, offering to sell, hypothecating
or otherwise dealing in or trading used or secondhand gold, silver or other
precious metals, used or secondhand precious gems and jewelry including, but
not limited to, articles made therefrom, coins, with or without numismatic
value, used jewelry of all descriptions, sterling silver, silver plate, semiprecious
gems or watches, other than as a consumer buying the same in a normal commercial
manner or as an incidental seller of such items so acquired.
No dealers in precious metals and gems shall engage in such business
until a license to do so has been obtained from the Chief of Police.
Every dealer in precious metals and gems shall maintain a legible and
complete record of each item purchased or received by the dealer including
the date and time acquired, a description of the article including weight
and any inscriptions, and the price paid therefor, together with the name,
residence address, occupation, date of birth, social security number, and
telephone number of the person from whom the dealer received the item. The
records shall be on forms approved by the Borough Police Department and shall
be available for inspection by the Borough Police Department at all times.
Every dealer in precious metals and gems shall deliver to the Chief
of Police the description of all items purchased or sold, within 48 hours
of the completion of the transaction on forms prescribed by the Chief of Police.
No dealer in precious metals and gems shall sell, melt, change the form
of, remove from the premises or otherwise dispose of any article bought or
received by the dealer in the borough within seven business days. Any dealer
wishing to store his merchandise other than on the premises where he is engaged
in business may make application to the Chief of Police for permission to
remove the same from the dealer's premises to the alternate designated location;
provided, however, that said location is in the borough.
